Abstract, One form of muamalah is cooperation in agriculture. In Wanayasa Village the implementation of cooperation is based on the custom of the community. This research formulates the problem of agricultural production sharing system according to muamalah fiqh, a practice of rice field system in Wanayasa Village, and fiqh muamalah review on the rice field parohan system in Wanayasa Village, Purwakarta City. The purpose of this research is to know the system of an agricultural product according to fiqh muamalah, the practice of rice field system in Wanayasa Village, and fiqh muamalah review on rice field parohan system in Wanayasa Village, Purwakarta City. This research uses field study method. The source of the research is to use primary data from interviews with landowners and tenants. Data collection techniques through observation, interviews, and literature studies. Data analysis technique used is qualitative analysis. The result of this research is a farming system in Islam called muzara'ah and mukhabarah. The type of agricultural cooperation in Wanayasa Village is fifth, seventh, and parohan. In terms of the implementation of the contract and the distribution of the fifth and the seventh, it is appropriate and not contradictory to the fiqh muamalah, but in the parohan cooperation done by Wanayasa Village society contains elements of uncertainty and injustice in the distribution of the results that could harm one party. Therefore cooperation with parohan systems is not allowed.Keywords: Fiqh, Muamalah, Parohan, a rice field.Abstrak. Salah satu bentuk muamalah adalah kerja sama dalam pertanian. Di Desa Wanayasa pelaksanaan kerja sama dilakukan berdasarkan adat kebiasaan masyarakat. Penelitian ini merumuskan masalah mengenai sistem bagi hasil pertanian menurut fikih muamalah, praktik sistem parohan sawah di Desa Wanayasa, dan tinjauan fikih muamalah pada sistem parohan sawah di Desa Wanayasa Kabupaten Purwakarta. Tujuan penelitian ini untuk mengetahui sistem bagi hasil pertanian menurut fikih muamalah, praktik sistem parohan sawah di Desa Wanayasa, dan tinjauan fikih muamalah pada sistem parohan sawah di Desa Wanayasa Kabupaten Purwakarta. Penelitian ini menggunakan metode studi lapangan. Sumber penelitian adalah menggunakan data primer hasil wawancara dengan pemilik lahan dan penggarap. Teknik pengumpulan datanya melalui observasi, wawancara, dan studi literatur. Teknik analisis data yang digunakan adalah analisis kualitatif. Hasil penelitian ini adalah sistem bagi hasil pertanian dalam Islam dinamakan muzara’ah dan mukhabarah. Jenis kerja sama pertanian di Desa Wanayasa adalah perlima, pertujuh, dan parohan. Dari segi pelaksanaan akad dan pembagian hasil kerja sama perlima, dan pertujuh sudah sesuai dan tidak bertentangan dengan fikih muamalah, namun pada kerja sama parohan yang dilakukan masyarakat Desa Wanayasa mengandung unsur ketidakjelasan dan ketidakadilan dalam pembagian hasilnya yang bisa merugikan salah satu pihak. Oleh karena itu kerja sama dengan sistem parohan tidak diperbolehkan.Kata Kunci: Fikih, Muamalah, Parohan, Sawah. |
