Abstract. Football is a very popular sport all over the world, even Indonesia as one of the countries that have the most population can not be separated from his love of foot exercise. Persib Bandung as one of Indonesia's top clubs that have collected many champions trophies, each year always bring national football players to international to have a solid club and strong. The contractual agreement in Islamic law is categorized into ijarah (lease), ie ijarah al-a'mal, ie lease agreement of human labor to do the work. Termination of player contract is a common thing among soccer that raises many questions with contract system conducted by Persib management Bandung. Dalam this research formulated problems as follows: (1) How to termination of contract in ijarah agreement? (2) How the contract system of football players in PT. Persib Bandung Bermartabat? (3) How to review ijarah agreement on contract system of football player in PT. Persib Bandung Bermartabat?. The method used in this research is descriptive analysis method of analysis. Data collection techniques used were interviews, documentation and literature study. The type of research used is field research (field research). The data analysis technique used is qualitative. The conclusions of this study (1) the termination of contract in ijarah contract is the fulfillment of the merged benefit, the end of the specified period and the completion of the work, which means that in the contracting system the contracted worker must complete his work thoroughly and according to the contract that has been made at the beginning the parties (2) Contract System in the football player Persib Bandung has not shown conformity with the terms of termination of contract in ijarah agreement that there are parties who are harmed, work that has been unaddressed but not fulfilled, the timing of the end of work is not in accordance that has been made. (3) The contracting system at Persib Bandung club is not in accordance with the contract of ijarah because there are some things that are not inaudible, there are the aggrieved parties, the work that has been acceded but not terpunuhi, the timing of the ending of work is not in accordance that has been made.Keywords: Akad Ijarah, Contract System, Persib BandungAbstrak. Sepak bola merupakan olahraga yang sangat digemari di seluruh dunia, bahkan Indonesia sebagai salah satu negara yang memiliki penduduk terbanyak tidak lepas dari kecintaanya terhadap olahraga kaki tersebut. Persib Bandung sebagai salah satu klub papan atas Indonesia yang telah banyak mengumpulkan trofi juara, setiap tahunnya selalu mendatangkan pemain-pemain sepak bola nasional sampai internasioanal supaya memiliki klub solid dan kuat. Perjanjian kontrak dalam hukum Islam digolongkan kepada ijarah (sewa-menyewa), yaitu ijarah al-a’mal, yakni perjanjian sewa-menyewa tenaga manusia untuk melakukan pekerjaan. Pemutusan kontrak pemain merupakan hal yang biasa dikalangan sepak bola sehingga menimbulkan banyak pertanyaan dengan sistem kontrak yang dilakukan oleh manajemen Persib Bandung.Dalam penelitian ini dirumuskan permasalahan sebagai berikut: (1) Bagaimana pemutusan kontrak dalam akad ijarah? (2) Bagaimana sistem kontrak pemain sepak bola di PT. Persib Bandung Beramartabat? (3) Bagaimana tinjauan akad ijarah terhadap sistem kontrak pemain sepak bola di PT. Persib Bandung Bermartabat?. Metode yang digunakan dalam penelitian ini adalah metode penelitan deskriptif analisis. Teknik pengumpulan data yang digunakan adalah wawancara, dokumentasi dan studi pustaka. Jenis penelitian yang digunakan adalah penelitian lapangan (field research). Teknik analisis data yang digunakan adalah kualitatif. Simpulan dari penelitian ini (1) ketentuan pemutusan kontrak dalam akad ijarah adalah terpenuhinya manfaat yang diakadkan, berakhirnya masa yang telah ditentukan dan selesainya pekerjaan, yang berarti dalam sistem kontrak pekerja yang telah dikontrak harus menyelesaikan pekerjaannya secara tuntas dan sesuai akad yang telah dibuat diawal oleh para pihak (2) Sistem Kontrak yang ada di dalam pemain sepak bola Persib Bandung belum menunjukan kesesuaian dengan ketentuan pemutusan kontrak dalam akad ijarah yaitu ada pihak yang dirugikan, pekerjaan yang sudah diakadkan namun tidak terpenuhi, waktu berakhirnya pekerjaan tidak sesuai yang sudah diakadkan. (3) Sistem kontrak pada klub Persib Bandung tidak sesuai dengan akad ijarah karna ada beberapa hal yang tidak terpunuhi, ada pihak yang dirugikan, pekerjaan yang sudah diakadkan namun tidak terpunuhi, waktu berakhirnya pekerjaan tidak sesuai yang sudah diakadkan.Kata Kunci: Akad Ijarah, Sistem Kontrak, Persib Bandung. |
