Abstract. Transactions rent is currently a favorite activities by the community especially in industrial areas, Because the dense indonesians and high price of urban land. PD. Berkah Ilahi Bandung is an example of a company that in operating use land the result of an agreement rent. But in the implementation happened the cancellation of the agreement when the land was the rent is currently taking place, and the cancellation was taken unilaterally by owner of the land. The purpose of this research is to knowing how a concept in Fikih Muamalah and Civil Law about the cancellation agreement tenancy land, how the implementation of cancellation agreement that happened in PD. Berkah Ilahi Bandung, and how analysis of Fikih Muamalah and Civil Law with the implementation of cancellation agreement in PD. Berkah Ilahi Bandung. The research is legal research (normative and empirical) with the approach case study analysis. The source of the data used was primary data obtained indirectly from tenants and the owner of land, then secondary data obtained from the study literature, journal, article, website and previous research. The results of the research was there is a mismatch between implementation the cancellation of the agreement done by owner of the land and owner of PD. Berkah Ilahi Bandung with the concept of Fikih Muamalah and Civil Law.Keywords: Fikih Muamalah, Civil Law, cancellation agreements, tenancy land.Abstrak. Transaksi sewa-menyewa saat ini menjadi kegiatan yang banyak diminati oleh masyarakat khususnya di daerah-daerah industri, karena semakin padatnya penduduk Indonesia dan mahalnya harga tanah di perkotaan. PD. Berkah Ilahi Bandung merupakan salah satu contoh perusahaan yang dalam operasionalnya menggunakan tanah hasil dari perjanjian sewa. Akan tetapi dalam pelaksanaannya terjadi pembatalan perjanjian ketika sedang berlangsung masa sewa-menyewa tanah tersebut, dan pembatalan dilakukan secara sepihak oleh pemilik tanah. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana konsep dalam Fikih Muamalah dan Hukum Perdata mengenai pembatalan perjanjian sewa-menyewa tanah, bagaimana pelaksanaan pembatalan perjanjian sewa-menyewa tanah di PD. Berkah Ilahi Bandung, dan bagaimana analisis Fikih Muamalah serta Hukum Perdata terhadap pelaksanakaan pembatalan perjanjian sewa-menyewa tanah di PD. Berkah Ilahi Bandung. Penelitian ini merupakan penelitian yuridis (yuridis normatif dan yuridis empiris) dengan pendekatan analisis studi kasus. Sumber data yang digunakan adalah data primer yang diperoleh langsung dari penyewa dan pemilik tanah, serta data sekunder yang diperoleh dari studi kepustakaan, jurnal, artikel, website maupun penelitian sebelumnya. Hasil yang diperoleh dalam penelitian ini adalah terdapat ketidaksesuaian antara pelaksanaan pembatalan perjanjian yang dilakukan oleh pemilik tanah dan pemilik PD. Berkah Ilahi Bandung dengan konsep Fikih Muamalah dan Hukum Perdata.Kata Kunci: Fikih Muamalah, Hukum Perdata, Pembatalan Perjanjian, Sewa-Menyewa Tanah. |
