Abstract. In the midst of the density of this modern era, ethical values seem to fade away, or even if arguably begin to disappear. The tendency of the community to be free as if it has spread in every corner of life. The loss of morals, ethics, norms of rules and similar things aimed at improving human behavior to be better as if it is useless. Whereas the application of the above values is none other than to prevent any damage caused by human hands and behavior. Trade conducted in Pasar Parit 11 is a trade conducted in public facilities. Public facilities are public places managed by the government for the community and used together. This study aims to find, describe and analyze Islamic business ethics to the Sale and Purchase in Public Facilities (Case Study of Parit Market 11).The method used in this research is descriptive qualitative, that is to describe and describe data systematically. Sources of data used in this study is divided into two primary data sources and secondary data sources. To help pengumplan data, the researchers used several methods such as observation methods and interview methods. Analytical tool in this research is descriptive qualitative data analysis that is presentation of data in written form and explain what is in accordance with data obtained from research result. The results of this research show that the activities undertaken by the Pasar Parit 11 traders are ethical and are prohibited in Islam because the trade is done in the Public Facility causing traffic congestion everyday, especially in the crowded hours, the obstruction of the right of Al-Murur pedestrian rights, and then do not take care of the environment by disposing of garbage disembarang places and under the rivers that cause not maintained cleanliness and comfort for the surrounding community.Keywords: Islamic Ethics, Fiqh Muamalah, Rights in Islam. Abstrak. Di tengah padatnya zaman yang serba modern ini, nilai etika seakan semakin luntur, atau bahkan kalau boleh dibilang mulai hilang. Kecenderungan masyarakat untuk berlaku bebas seakan sudah mewabah disetiap penjuru kehidupan. Hilangnya moral, etika, norma aturan serta berbagai hal sejenis yang bertujuan untuk memperbaiki tingkah laku manusia agar lebih baik seakan tidak berguna. Padahal diterapkannya nilai-nilai di atas tidak lain untuk mencegah adanya kerusakan yang ditimbulkan karena ulah tangan dan tingkah manusia. Perdagangan yang dilakukan di Pasar Parit 11 merupakan perdagangan yang dilakukan di fasilitas publik. Fasilitas public merupakan tempat umum yang di kelola oleh pemerintah untuk masyarakat dan digunakan secara bersama-sama, tetapi hal ini dipergunakan oleh pedagang untuk kepentingan individu. Penelitian ini bertujuan untuk mengetahui, mendeskripsikan dan menganalisis etika bisnis Islam terhadap Jual Beli di Fasilitas Publik (Studi Kasus Pasar Parit 11). Metode yang digunakan dalam penelitian ini adalah deskriptif kualtatif, yaitu menggambarakan dan menguraikan data secarasistematik. Sumber data yang digunakan dalam penelitian ini terbagi menjadi dua yaitu sumber data primer dan sumber data sekunder. Untuk membantu pengumplan data, maka peneliti menggunakan beberapa metode diantaranya metode observasi dan metode wawancara. Alat analisis pada penelitian ini adalah analisa data deskriptif kualitatif yaitu penyajian data dalam bentuk tulisan dan menerangkan apa adanya sesuai dengan data yang diperoleh dari hasil penelitian. Hasil penelitan ini mununjukkan bahwa aktivitas yang dilakukan oleh pedagang Pasar Parit 11 merupakan perdagangan yang melanggar etika dan dilarang dalam Islam, karena perdagangan tersebut dilakukan di Fasilitas Publik menyebabkan kemacetan arus lalu lintas setiap harinya terutama di jam-jam padat, terhalangnya hak Al-Murur yaitu hak pejalan kaki, kemudian tidak menjaga lingkungan dengan membuang sisa sampah disembarang tempat dan di bawah sungai-sungai yang menyebabkan tidak terjaganya kebersihan dan kenyamanan bagi masyarakat sekitar.Kata Kunci : Etika Islam, FiqhMuamalah, Hak Islam. |
