Abstract. Nowdays many umroh travel agents offer umroh sale. Many people are finally interested. Most people prefer going umroh to hajj because of the affordable price and they do not need to queue for going hajj. But unfortunately some managers of travel agents have poor financial governance. One of the examples is the case of the travel agent PT. Solusi Balad Lumampah (abbreviated PT.SBL) that occurred in Bandung. The travel agent was indicated to do money game. Based on the description the author formulated the problem in the form of questions as follows: how the concept of fiqh mu’amalah and positive law to practice of money game was, how the practice of selling sale tickets for umroh conducted by PT. Solusi Balad Lumampah in Bandung was, and how the review of fiqh mu’amalah and positive law on practice of money game committed by PT. Solution Balad Lumampah in Bandung city was.The conclusions of this research are first, money game is prohibited based on the concept of fiqh muamalah and positive law, second the trade in sale tickets for umroh at PT. Solusi Balad Lumampah in Bandung was proved to commit money game with ponzi scheme, third the jurisprudence of muamalah against the practice of money game on the tickets at PT.SBL stated that it is prohibited because there are tadlis and gharar elements in it where the money game on sale ticket is a tadlis, whereas the behavior that do it is called gharar. The positive legal review states that it is a form of fraud in violation of law number 7 of 2014 concerning trade related to money game, law number 8 of 1999 concerning consumer protection; and the Criminal Code (Penal Code).Keyword: Money Game, Muamalah, Positif Abstrak. Dewasa ini banyak travel umrah yang menawarkan promo umrah murah. Banyak masyarakat yang akhirnya tertarik karena selain harganya yang terjangkau masyarakat juga banyak yang lebih memilih umrah karena panjangnya antrian haji. Namun sayangnya beberapa pengelola travel memiliki tata kelola keuangan yang buruk . Salah satu contohnya yaitu pada kasus travel PT. Solusi Balad Lumampah (disingkat PT.SBL) yang terjadi di kota Bandung yang terindikasi melakukan money game. Berdasarkan uraian tersebut maka dirumuskan masalah dalam bentuk pertanyaan sebagai berikut: Bagaimana konsep fikih muamalah dan konsep hukum positif terhadap praktik money game? Bagaimana praktik penjualan tiket promo umroh yang dilakukan oleh PT. Solusi Balad Lumampah di kota Bandung? Bagaimana tinjauan fikih muamalah dan hukum positif terhadap praktik money game yang dilakukan oleh PT. Solusi Balad Lumampah di kota Bandung?. Simpulan dari penelitian ini adalah pertama, money game dilarang berdasarkan konsep fikih muamalah dan hukum positif. Kedua, pelaksanaan jual beli tiket promo umrah di PT. Solusi Balad Lumampah kota Bandung melakukan money game dengan skema ponzi dalam penjualan tiket promonya. Ketiga, Tinjauan fikih muamalah terhadap praktik money game pada penjualan tiket promo umrah di PT.SBL menyatakan bahwa hal itu dilarang karena terdapat unsur tadlis dan gharar didalamnya dimana money game pada penjualan tiket promo merupakan bentuk tadlis sedangkan perilaku yang melakukannnya disebut gharar. Adapun tinjauan hukum positif menyatakan bahwa hal tersebut merupakan bentuk penipuan yang melanggar undang-undang nomor 7 tahun 2014 tentang perdagangan yang berkaitan tentang money game, undang-undang nomor 8 tahun 1999 tentang perlindungan konsumen; dan Kitab Undang-Undang Hukum Pidana (KUHP).Kata kunci: Money Game, Muamalah, Positif |
