Abstract: A contract occurs if a party agrees to make an agreement. But negligence in carrying out obligations (wanprestation) in the contract can happen. In the shopee marketplace application the seller is free to withdraw his income at any time with the time period determined by the shopee. In fact, many sellers complain that the disbursement of funds is not in accordance with a predetermined period of time. This study aims to find out the muqalah review of the default of the shopee online marketplace. The method used in this study is normative juridical and uses descriptive data analysis techniques. Shopee has defaulted on sellers who use shopee online marketplace services because the shopee does not disburse funds in a timely manner. According to the fiqh review, the shopee has been late in fulfilling its obligations in the process of disbursing funds, which is called at-taqshir, because the shopee does not fulfill an agreement that the shopee should have done.Keywords: Wanprestation, Contract, Marketplace.Abstrak: Akad terjadi jika suatu pihak bersepakat untuk melakukan perikatan. Namun kelalaian dalam melakukan kewajiban (wanprestasi) dalam akad bisa saja terjadi. Dalam aplikasi marketplace shopee penjual bebas mencairkan dana penghasilannya kapanpun dengan jangka waktu yang sudah ditentukan oleh pihak shopee. Pada kenyataannya banyak penjual yang mengeluhkan bahwa pencairan dana tidak sesuai dengan jangka waktu yang sudah ditentukan. Penelitian ini bertujuan untuk mengetahui tinjauan fikih muamalah terhadap wanprestasi marketplace online shopee. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dan menggunakan Teknik analisis data deskriptif. Pihak shopee telah melakukan wanprestasi terhadap penjual yang mengunakan jasa marketplace online shopee dikarenakan pihak shopee tidak melakukan pencairan dana secara tepat waktu. Menurut tinjauan fikih muamalah pihak shopee telah terlambat memenuhi kewajibannya dalam proses pencairan dana yang disebut dengan at-taqshir karena pihak shopee tidak memenuhi suatu perjanjian yang seharusnya pihak shopee lakukan.Kata Kunci: Wanprestasi, Akad, Marketplace. |
