Abstract. The progress of science in creating information technology advances in the form of internet media raises the negative side that raises new crimes committed through cyberspace in other words Cybercrime, one of which is the crime of pornography. The identificationof the problem are: (1) How to enforce the law of pornography crime on internet media based on The Act Number 19 Year 2016 concerning Information and Electronic Transactions; (2) How its towards pornographic owners in Indonesia. The matters of pornography in Indonesia has been regulated by three legal umbrella, they are Criminal Code, The Act Number 44 Year 2008 on Pornography and The Act Number 19 Year 2016 concerning Information and Electronic Transactions. Both of them provided that the circulation of pornographic content is prohibited. The results of this study said that the circulation of pornography occurred in Indonesia only ensnared the perpetrators of the maker and the perpetrators of the spread, without ensnaring the owners of pornographic sites on internet media. Therefore the effort that needs to be done by the government is to add provisions specifically regulating the responsibilities of owners of pornographic sites on the internet.Keywords: Cybercrime, Pornography, Internet MediaAbstrak. Kemajuan ilmu pengetahuan dalam menciptakan kemajuan teknologi infotmasi berupa media internet menimbulkan sisi negatif yang memunculkan tindak kejahatan baru yang dilakukan melalui dunia maya dengan kata lain Cybercrime, salah satunya adalah kejahatan pornografi. Maka dalam hal ini dirumuskan identifikasi masalahnya berupa: (1) Bagaimana penegakan hukum tindak pidana pornografi di media internet berdasarkan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik; (2) Bagaimana implementasi penegakan hukum tindak pidana pornografi di media internet berdasarkan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik terhadap pemilik situs pornografi di Indonesia.Peredaran pornografi di Indonesia memiliki tiga payung hukum, diantaranya KUHPidana, Undang-Undang Nomor 44 Tahun 2008 tentanh Pornografi dan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik. Dari ketiga ketentuan hukum disebutkan bahwa peredaran konten pornografi merupakan kegiatan yang dilarang. Dari hasil penelitian ini ditemukan kesimpulan bahwa peredaran pornografi yang terjadi di Indonesia hanya menjerat pelaku pembuat serta pelaku penyebar, tanpa menjerat pemilik situs pornografi di media internet. Oleh karena itu upaya yang perlu dilakukan oleh pemerintah adalah dengan menambah ketentuan yang khusus mengatur tentang tanggung jawab pemilik situs pornografi di internet.Kata kunci: Cybercrime, Pornografi, Media Internet |
