Issues raised by the author are: 1) How does the application discretion by the police in the jurisdiction of Cibeunying Kaler? 2) What are the factors that drive and impede the implementation of the investigator's discretion as law enforcement jurisdiction of the Police of Cibeunying Kaler? The method used in this study is juridical sociological. Sociological juridical approach is a study that focuses on the behavior of individuals or society in relation to the law. In this case done by assessing and logically examine legal aspects of the issue of enforcing the law, they are "in abstracto" as well as "In concerto", which is an actual problem that lately under the spotlight of the public (in concerto). Based on the results of research and discussion can be concluded, the patterns wisdom of discretion is applied in practice the police in the jurisdiction police of Cibeunying Kaler depending on local circumstances such as by way of peace between the offenders with the victim, then made his case, and so on. In addition, in the act of discretion by investigators are factors that influence it. Internal driving factors consist of the substance of legislation, instructions from the leadership, law enforcement investigators, the situation in the investigation, an external factor in discretion by investigators is the support of the community. Besides, there are inhibiting factors in discretion, which are still weak law enforcement in Indonesia, financial constraints, local police officers, investigators knowledge, as well as participation of the parties.Dikresi polisi merupakan suatu kewenangan untuk bertindak atas kewenangan sendiri yang berdasarkan kepentingan umum. Diskresi polisi diatur dalam Pasal 18 Ayat 1 Undang-undang Nomor 8 Tahun 2002 tentang Kepolisian Negara Republik Indonesia. Diskrsi yang dilakukan oleh penyidik kepolisian pada dasarnya lebih mengutamakan pencapain tujuan sasarannya daripada legalitas hukum yang berlaku. Permasalahn yang akan muncul apabila penegak hukum dalam hal ini polisi yang dengan kewenangan diskresinya justru malah tidak menegakkannya, melainkan memaafkan, mengenyampingkan, atau mengambil tindakan diluar proses yang ditentukan. Permasalahan yang diangkat oleh penulis adalah 1) Bagaimana penerapan diksresi oleh kepolisian di wilayah hukum Polsekta Cibeunying Kaler ? 2) Faktor-faktor apa yang mendorong serta menghambat penerapan diskresi olwh penyidik selaku penegak hukum din wilayah hukum Polsekta Cibeunying Kaler ? Metode yang digunakan dalam penelitian ini adalah yuridis sosiologis. Metode pendekatan yuridis sosiologis adalah suatu penelitian yang menitik beratkan perilaku individu atau masyarakat dalam kaitannya dengan hukum. Dalam hal ini dilakukan dengan mengkaji dan menguji secara logis aspek hukum dalam masalah menegakkan hukum, baim secara “in abstracto” maupun secara “In concerto”, yang merupakan masalah actual yang akhir-akhir ini mendapat sorotan tajam dari masyarakat (in concerto). Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan, mengenai pola-pola kebijaksanaan diskresi yang diterapkan dalam praktek kepolisian di wilayah hukum Polsekta Cibeunying Kaler tergantung dari situasi dan kondisi setempat seperti dengan cara perdamaian antara pihak pelanggar hukum dengan si korban, kemudian dilakukan gelar perkara dan sebagainya. Selain itu dalam pelaksanaan tindakan diskresi oleh penyidik terdapat bebarapa faktor yang mempengaruhinya. Faktor pendorong internal terdiri atas substansi peraturan perundang-undangan, instruksi dari pimpinan, penyidik sebagai penegak hukum, situasi dalam penyidikan, faktor eksternal dalam diksresi oleh penyidik adalah dukungan dari masyarakat. Disamping itu terdapat faktor penghambat dalam diksresi, diantaranya adalah masih lemahnya penegakan hukum di Indonesia, kendala financial, oknum aparat, pengetahuan penyidik, serta adanaya partisipasi para pihak.
