Abstract. "Criminal Law Enforcement By the Illegal Levies Task Force Based on Presidential Regulation Number 87 of 2016 Against State Civil Apparatus Who Conducts Illegal Levies Associated With Law Number 5 Year 2014 concerning State Civil Apparatus" By: Ahead of Anggara Mahardika Illegal levies are actions carried out by a person or civil servant or state official by requesting payment of a sum of money that is not appropriate or not based on the regulations relating to the payment. This is often equated with acts of extortion, fraud or corruption. Pungli itself actually occurs because of unlimited human needs. Many perpetrators of illegal levies at this time also have a background in the State Civil Apparatus (ASN) which should be the executor of procedures and mechanisms of the community in managing things. Employees of the State Civil Apparatus (Employee ASN) are civil servants and government employees with work agreements that are appointed by staffing officials and entrusted with duties in a governmental position or surrendered by another state and paid according to legislation. Civil Servants (PNS) are Indonesian citizens who fulfill certain requirements, are appointed as ASN Personnel on a regular basis by staffing officials to occupy government positions. this study discusses how the implementation of the functions of the Clean Sweep Team of Illegal Levies according to Presidential Regulation Number 87 of 2016 as well as how law is enforced against the Civil Apparatus of the State Conducting Illegal Levies according to Law Number 5 of 2014. This research is also to find out the functions The Clean Sweep Team of Illegal Levies in accordance with Presidential Regulation Number 87 Year 2016 and To find out the role of the government in tackling criminal acts of illegal levies that harm society. This study uses a normative juridical approach and empirical jurisdiction.Keywords: Wild Levy, State Civil Apparatus, Saber Pungli TeamAbstrak. Pungutan liar adalah perbuatan yang dilakukan oleh seseorang atau Pegawai Negeri atau Pejabat Negara dengan cara meminta pembayaran sejumlah uang yang tidak sesuai atau tidak berdasarkan peraturan yang berkaitan dengan pembayaran tersebut. Hal ini sering disamakan dengan perbuatan pemerasan, penipuan atau korupsi. Pungli sendiri sebetulnya terjadi disebabkan karena kebutuhan manusia yang tidak terbatas. Para pelaku pungutan liar pada saat ini juga banyak yang berlatar belakang Aparatur Sipil Negara (ASN) yang seharusnya menjadi petugas pelaksana prosedur dan mekanisme masyarakat dalam mengurus sesuatu. Pegawai Aparatur Sipil Negara (PegawaiASN) adalah pegawai negeri sipil dan pegawai pemerintah denganperjanjian kerja yang diangkat oleh pejabat pembina kepegawaian dan diserahi tugas dalam suatu jabatan pemerintahan atau diserahitugas negara lainnya dan digaji berdasarkan peraturan perundang-undangan. Pegawai Negeri Sipil (PNS) adalah warganegara Indonesia yang memenuhi syarat tertentu, diangkat sebagai Pegawai ASN secara tetap oleh pejabat pembina kepegawaian untuk menduduki jabatan pemerintahan. penelitian ini membahas tentang Bagaimanakah pelaksanaan fungsi- fungsi Tim Sapu Bersih Pungutan Liar menurut Peraturan Presiden Nomor 87 Tahun 2016 serta Bagaimanakah penegakkan hukum terhadap Aparatur Sipil Negara yang Melakukan Pungutan Liar menurut Undang- Undang Nomor 5 Tahun 2014. Penelitian ini juga untuk mengetahui Fungsi- fungsi Tim Sapu Bersih Pungutan Liar sesuai dengan Peraturan Presiden Nomor 87 Tahun 2016 dan Untuk mengetahui peran pemerintah dalam menanggulangi tindak pidana pungutan liar yang merugikan masyarakat. Penelitian ini menggunakan pendekatan yuridis normatif dan yuridis empiris.Kata Kunci: Pungutan Liar, Aparatur Sipil Negara, Tim Saber Pungli. |
