Abstract. Land acquisition for public interests often creates problems between parties who control the land and those who need land. One of them is the procurement of land for the construction of a Row House at Tamansari RW 11. In this construction, the Bandung City Government stipulates that there is no damages to the residents, which is only spirituality money and the settlement of the Row Houses. The society who receive the priority of resettlement are only given relief in the form of free rent for the first 5 years and so must pay. This research uses a normative juridical method with a descriptive analysis specifications. Data collection techniques used in this research are library studies and interviews, with a descriptive analytical research specification. The research result show that, first the provision of a Row House is not a form of damages, but it is a compensation. However, in the Decree of DPKP3, it was stated that in the construction of Row Houses, one of them referred to the Law Regulation No. 2 of 2012. So that the City of Bandung Government must submit to all provisions in the regulation, including provisions regarding the damages. Secondly, with the policy of the City Government of Bandung not to provide compensation and should the society pay their rent for the rest of their lives not in accordance with the provisions in the principle of Islamic justice.Keywords: Compensation, Row House, Principle of Islamic Justice.Abstrak. Pengadaan tanah untuk kepentingan umum seringkali menimbulkan persoalan antara pihak yang menguasai tanah dengan pihak yang membutuhkan tanah. Salah satunya yaitu pengadaan tanah untuk pembangunan Rumah Deret di Tamansari RW 11. Dalam pembangunan tersebut Pemerintah Kota Bandung menetapkan bahwa tidak ada ganti rugi kepada warga, yang ada hanya uang kerohiman dan penghunian kembali Rumah Deret. Warga yang memperoleh prioritas penghunian kembali hanya diberikan keringanan berupa gratis sewa selama 5 tahun pertama dan seterusnya harus membayar. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah studi kepustakaan dan wawancara, dengan analisis data secara kualitatif. Hasil penelitian menunjukkan bahwa, pertama pemberian Rumah Deret bukanlah bentuk ganti rugi, melainkan kompensasi. Namun dalam SK DPKP3 menyebutkan bahwa dalam pembangunan Rumah Deret salah satunya mengacu pada UU No.2 Tahun 2012. Sehingga Pemerintah Kota Bandung harus tunduk kepada setiap ketentuan yang ada pada undang-undang tersebut termasuk ketentuan mengenai ganti rugi. Kedua, dengan kebijakan Pemerintah Kota Bandung tidak memberikan ganti kerugian dan mengharusnya warga membayar sewa seumur hidupnya tidak sesuai dengan ketentuan dalam asas keadilan islam.Kata Kunci: Ganti Rugi, Rumah Deret, Asas Keadilan Islam. |
