Abstract. The conduct of this research is to know how authority investigators kpk in corruption eradication and how legal protection to investigators the corruption eradication commission. By using the method research juridical normative. Invite Law act in indonesia is only regulates the kpk just duties and obligations , but does not include a regulation on the protection of the law against investigators kpk , it this is a causing investigators kpk got the intervention of any parties both in the form of assault , terror or even in criminal acts. These interventions can devoted either directly to investigators kpk or his family .Duties and the authority of kpk a very wide so should a investigators kpk their duty and its responsibilities having special regulation of rules on protection laws against investigators KPK. The government could draw up or come up with some rules of law this mou of Law invited as guests to his regulate the procedures to the protection of the law against inquiry into the violence of poverty alleviation commission pac and were based on human rights and the theory of the protection of the law as well as hear and to comprehend and the protection of the law by some to be the expert as whose upbringing was described and expounded at a discussion of earlier about the protection of the law being in accordance with duty and the authority of KPK. In executing duties and authority should investigators kpk shelter law so that the special duties and obligations set out and arranged in the Number 30 of 2002 act number year on the corruption eradication commission viable and berlauku fully without any intervention from any party.Keywords : Law Protection, Intervetion, Investigators The Commission.Abstrak. Tujuan dilakukannya penelitian ini adalah utnuk mengetahui bagaimana wewenang penyidik Komisi Pemberantasan Korupsi dalam pemberantasan tindak pidana korupsi dan bagaimana perlindungan hukum terhadap penyidik Komisi Pemberantasan Korupsi. Dengan menggunakan metode penelitian yuridis normative. Undang – Undang di Indonesia hanya mengatur mengenai tugas dan kewajiban KPK saja, namun tidak menyertakan peraturan mengenai perlindungan hukum terhadap penyidik KPK , hal ini yang menyebabkan penyidik KPK mendapat intervensi dari pihak manapun baik berupa penyerangan , teror atau bahkan di kriminalisasi. Intervensi tersebut dapat ditujukan baik secara langsung terhadap penyidik KPK atau keluarganya. Tugas dan wewenang KPK yang sangat luas maka sudah sepatutnya seorang penyidik KPK dalam menjalankan tugas dan wewenangnya memiliki peraturan khusus berupa aturan mengenai perlindungan hukum terhadap penyidik KPK. Pemerintah dapat menyusun atau membuat peraturan perundang – undangan yang mengatur tentang perlindungan hukum terhadap penyidik KPK dengan berpatokan pada HAM dan teori perlindungan hukum serta pengertian perlindungan hukum oleh beberapa ahli sebagaimana yang telah dijelaskan dan diuraikan pada pembahasan sebelumya tentang perlindungan hukum yang sesuai dengan tugas dan wewenang KPK. Dalam menjalan tugas dan wewenangnya sebaiknya penyidik KPK mendapatkan perlindungan hukum yang khusus sehingga tugas dan kewajiban KPK yang tertuang dan diatur dalam Undang – Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Korupsi dapat berjalan dan berlauku sepenuhnya tanpa ada intervensi dari pihak manapun.Kata Kunci : Perlindungan Hukum, Intervensi, Penyidik KPK. |
