Currently growing variety of criminal offenses, in particular organized crime with tough modus operandi revealed. Obstacles faced by the criminal justice system (SPP) in uncovering the crime, that obtaining the evidence in accordance with the Criminal Procedure Code. Government through UUPSK as the ratification of the UN Convention (UNCAC and UNTOC) governing the protection of witnesses and victims, including the provisions regarding whistleblower and justice collaborator. Whistleblower is a reporting criminal acts while justice collaborator is a witness who cooperated. The study aims to determine how the practice and implementation of SEMA No.4 of 2011 to provide legal protection for whistleblowers and justice collaborator. Research using normative juridical approach, specification of descriptive analysis, with a literature study research stage, and qualitative analysis of normative data. Reality legal protection of the whistleblower and the justice collaborator who arranged UUPSK been implemented according to regulations. However, because law enforcement also includes components of the SPP, then law enforcement will be in accordance subjectivity of each law enforcement agency. The obstacle of implementation SEMA No.4 of 2011 provides protection for whistleblowers is justice collaborator is the connective power of the SEMA is not strong, and will be an appeal to the judge, so the judge's decision will be different. In addition, SPP has policies and consideration of each in providing protection to the whistleblower and the justice collaborator.
Saat ini berbagai tindak pidana semakin berkembang, khususnya organized crime dengan modus operandi yang sulit terungkap. Kendala yang dihadapi oleh sistem peradilan pidana (SPP) dalam mengungkap tindak pidana, yaitu memperoleh alat bukti sesuai ketentuan KUHAP. Pemerintah melalui UUPSK sebagai ratifikasi Konvensi PBB (UNCAC dan UNTOC) mengatur perlindungan terhadap saksi dan korban, termasuk ketentuan mengenai whistleblower dan justice collaborator. Whistleblower adalah pelapor tindak pidana sedangkan justice collaborator ialah saksi pelaku yang bekerjasama. Penelitian bertujuan untuk mengetahui bagaimana praktik dan implementasi SEMA No.4 Tahun 2011 dalam memberikan perlindungan hukum bagi whistleblower dan justice collaborator. Penelitian menggunakan pendekatan yuridis normatif, spesifikasi penelitian deskriptif analisis, dengan tahap penelitian studi kepustakaan, dan analisis data normatif kualitatif. Realitas perlindungan hukum terhadap whistleblower dan justice collaborator yang diatur UUPSK telah dilaksanakan sesuai ketentuan. Namun, karena penegakan hukum juga mencakup komponen-komponen SPP, maka penegakan hukum akan sesuai subjektivitas dari masing-masing instansi penegak hukum. Pengahambat implementasi SEMA No.4 Tahun 2011 dalam memberikan perlindungan bagi whistleblower adalah justice collaborator adalah daya ikat dari SEMA yang tidak kuat dan hanya bersifat himbauan bagi para hakim, sehingga putusan hakim akan berbeda. Selain itu, SPP memiliki kebijakan dan pertimbangan masing-masing dalam memberikan perlindungan terhadap whistleblower dan justice collaborator.
