Abstract. The right to life is the highest degree of rights. This right is a right that cannot be reduced in its fulfillment either by the state or by other people. In international law, one of the sources of international law that regulates the right to life is the International Covenant on Civil and Political Rights. Fulfillment of the right to life in the Covenant is an obligation and must be a priority of the participating countries in the covenant. The right to life is not the only fundamental right stipulated in the Covenant, there are also other rights which are considered to be general legal principles, namely the right to fair trial and the presumption of innocence. This right is regulated in article 14 of the covenant, in this article every suspect of a criminal offense has the right to get a fair and competent trial given by the State regardless of religion, race, ethnicity or color, in this article also regulates the right to presumption of innocence. According to the Draft articles on the Responsibility of States for the International Wrongful Acts, there is an international responsibility that the State has if the State fails to respect, fulfill and protect these rights. The Government of the Philippines in this matter is a State party that has ratified the International Covenant on Civil and Political Rights and Additional Protocols to the Covenant. This research aims to know and understand what forms of responsibility the Philippine government can do for violations of living rights in the form of extra-judicial killings of suspected drug users and dealers according to the International Covenant on Civil and Political Rights. In this study, the approach method used in this study is a normative juridical approach. Research Specifications, this research is descriptive analytical. Type of data, namely secondary data. Data collection is done through library research (library research) on secondary data. The results of this study indicate that the Philippine government has violated the International Covenant on Civil and Political Rights and is internationally responsible for carrying out a remedial action against victims of human rights violations. Keywords: Responsibility, Extra-Judicial, Philippine GovermentAbstrak. Hak hidup merupakan hak yang paling tinggi derajatnya. Hak tersebut adalah hak yang tidak dapat dikurangi dalam pemenuhannya baik oleh negara ataupun oleh orang lain. Dalam hukum internasional salah satu sumber hukum internasional yang mengatur tentang hak hidup adalah Kovenan Internasional Hak-Hak Sipil dan Politik. Pemenuhan hak hidup dalam Kovenan tersebut merupakan kewajiban dan harus menjadi prioritas Negara-negara peserta dalam kovenan tersebut. Hak hidup bukan satu-satunya saja hak yang fundamental yang diatur di dalam Kovenan, terdapat juga hak lainya yang dianggap menjadi prinsip hukum umum, yaitu hak untuk mendapatkakn peradilan yang adil dan hak atas praduga tidak bersalah. Hak ini diatur dalam pasal 14 kovenan, dalam pasal ini setiap terduga pelaku dari tindak kejahatan memiliki hak untuk mendapatkan peradilan yang adil dan kompeten yang diberikan oleh Negara tanpa melihat dari Agama, Ras, Suku atau warna kulit, dalam pasal ini juga mengatur tentang hak atas praduga tidak bersalah. Menurut Draft articles on Responsibility of States for Internationally Wrongful ActsTerdapat suatu tanggung jawab secara internasional yang dimiliki Negara jika Negara gagal untuk menghargai, memenuhi dan melindungi hak-hak tersebut. Pemerintah Filipina dalam hal ini merupakan Negara peserta yang telah meratifikasi Kovenan Internasional Hak-Hak Sipil dan Politik dan Protokol Tambahan terhadap kovenan tersebut. Penelitian ini bertujuan untunk mengetahui dan memahami bentuk tanggung jawab apa saja yang pemerintah Filipina dapat lakukan terhadap pelanggaran hak hidup yang berupa pembunuhan ekstra yudisial kepada terduga pengguna dan pengedar narkoba menurut Kovenan Internasional Hak-hak Sipil dan Politik, Dalam penelitian ini, metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif. Spesifikasi Penelitian, penelitian ini bersifat deksriptif analitis. Jenis data, yaitu data sekunder. Pengumpulan data dilakukan melalui studi kepustakaan (library research) terhadap data sekunder. Hasil penelitian ini menunjukkan bahwa pemerintah filipina telah melanggar Kovenan Internasional Hak-hak Sipil dan Politik dan bertanggung jawab secara internasional untuk melakukan sebuah tindakan pemulihan terhadap para korban pelanggaran hak asasi manusia.
