In Indonesia capital punishment is the toughest punishment of the types of punishment threat contained in the Criminal Code is the heaviest criminal that is the implementation of the seizure of human life, it is not surprising that in determining the death penalty there are many opinions that are pro and contra among jurists or the public itself. There is a main objective to be achieved from this research is to know the legal protection of the defendant who sentenced to death and to know the accountability of the state against the death row inmates who have been executed in death connected with human rights. The research method used to answer the problems in the thesis is to use normative juridical research methods. Normative juridical research is the research undertaken and addressed to written regulations and the application of legislation or positive legal norms that are closely related to the issues discussed. The results showed legal protection against defendants who were sentenced to death, especially the state accountability of death row convicts who have been executed and proven innocent in connection with human rights. |

Di Indonesia pidana mati merupakan hukuman yang terberat dari jenis-jenis ancaman hukuman yang tercantum dalam KUHP merupakan pidana terberat yaitu yang pelaksanaannya berupa perampasan terhadap kehidupan manusia, maka tidaklah heran apabila dalam menentukan hukuman mati terdapat banyak pendapat yang pro dan kontra dikalangan ahli hukum ataupun masyarakat itu sendiri. Terdapat tujuan utama yang ingin dicapai dari penelitian ini yaitu untuk mengetahui perlindungan hukum terhadap terdakwa yag dijatuhi hukuman mati serta ntuk mengetahui pertanggungjawaban negara terhadap terpidana mati yang telah di eksekusi mati di hubungkan dengan hak asasi manusia. Metode penelitian yang digunakan untuk menjawab persoalan-persoalan dalam skripsi adalah menggunakan metode penelitian yuridis normatif. Penelitian yuridis normatif adalah penelitian yang dilakukan dan ditujukan kepada peraturan-peranturan tertulis dan penerapan dari peraturan perundang-undangan atau norma-norma hukum positif yang erat kaitannya dengan permasalahan yang dibahas. Hasil penelitian menunjukan perlindungan hukum terhadap terdakwa yang dijatuhi hukuman mati khususnya pertanggungjawaban negara terhadap terpidana mati yang telah di eksekusi mati dan terbukti tidak bersalah di hubungkan dengan hak asasi manusia. |
