Abstract. One of the requirements for ships to safely sail is that the ship must fulfill the seaworthiness and Harbormaster is government official at the port which has a function to oversee the seaworthiness of the ship. On June 18, 2018 Sinar Bangun motorized boat sank at Lake Toba which caused hundreds of victims, allegedly the seaworthiness of Sinar Bangun motorized boat was not fulfilled. Based on this phenomenon, the problem in this research is formulated as follows: 1) how the function of Harbormaster at port of Lake Toba achieve the safety of lake motorized boat transportation?and 2) how the implementation of Government Regulation Number 61 of 2009 on Port Affairs towards the function of Harbormaster at port of Lake Toba? Researcher using a normative juridical approach in which the study is carried out on the rules and principles relating to the function of Harbormaster, water transportation on lake. Data collection that used is tthrough a literature study of primary, secondary, and tertiary legal materials related to the topic of the problem which will later be used as a reference to solve problems as part of data analysis. The results of the research are: 1) the Department of Transportation of Samosir Regency of North Sumatra Province carrying out the function of Harbormaster at Simanindo Port but it is incomplete and not implemented according to the laws and regulations. 2) the absence of the implementation of Government Regulation Number 61 of 2009 on Port Affairs related to the Harbormaster in Simanindo Port has caused human error that make the function of Harbormaster does not work as it should be.Key Words: Function of Harbormaster, Ship Safety, Ship’s Seaworthiness . Abstrak. Salah satu syarat kapal dalam selamat berlayar adalah kapal harus memenuhi kelaiklautan kapal dan Syahbandar adalah pejabat pemerintah yang memiliki fungsi untuk mengawasi kelaiklautan kapal tersebut. Pada tanggal 18 Juni 2018 KM Sinar Bangun tenggelam di perairan Danau Toba yang menyebabkan ratusan korban, diduga kelaiklautan kapal KM Sinar Bangun tidak terpenuhi. Berdasarkan fenomena tersebut, permasalahan dalam penelitian ini adalah sebagai berikut: 1) bagaimana fungsi Syahbandar di Pelabuhan Danau Toba mencapai keselamatan kapal motor angkutan di perairan danau? dan 2) bagaimana implementasi Peraturan Pemerintah Nomor 61 Tahun 2009 tentang Kepelabuhanan terhadap fungsi syahbandar di Pelabuhan Danau Toba. Peneliti menggunakan pendekatan yuridis normatif di mana kajian dilakukan terhadap kaidah-kaidah dan asas-asas yang berkaitan dengan fungsi syahbandar, angkutan perairan di danau, dan keselamatan kapal Teknik pengumpulan data yang digunakan adalah melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tertier yang berkaitan dengan topik permasalahan yang nantinya dijadikan rujukan untuk menyelesaikan permasalah sebagai bagian dari analisis data. Hasil dari penelitian adalah: 1) Dinas Perhubungan Kabupaten Samosir Provinsi Sumatera Utara melaksanakan fungsi syahbandar di Pelabuhan Simanindo namun tidak lengkap dan tidak dilaksanakan sesuai peraturan perundang-undangan. 2) tidak adanya implementasi Peraturan Pemerintah Nomor 61 Tahun 2009 tentang Kepelabuhanan yang berkaitan dengan syahbandar di Pelabuhan Simanindo yang menyebabkan kendala timbulnya kesalahan manusia/human error sehingga fungsi syahbandar tidak berjalan sebagaimana mestinya.Kata Kunci: Fungsi Syahbandar, Keselamatan Kapal, Kelaiklautan Kapal. |
