dc.description Abstract. Marijuana is one of the most abused types of narcotics in Indonesia, the National Narcotics Agency (BNN) reported that there are approximately two million cannabis users in Indonesia making marijuana the most widely used substance in Indonesia. The Netherlands is one of the countries that let the sale of marijuana in small quantities in coffeeshops in accordance with the rules of Opium Art, but planting marijuana and selling it to the coffeeshop is still classified as a violation of the law. For the Dutch state hemp user is not a threat but a source of state income. The classification of marijuana (Group I) is considered outdated and has a negative impact on violators such as users and cannabis farmers. The role of government through state institutions in the eradication of illegal marijuana circulation practice in the State of Indonesia with the Dutch State has a very important role. The Dutch, however, prefer to legalize the marijuana in certain amounts and strict regulations to reduce the illicit trafficking of marijuana. The Dutch government can directly control the circulation of marijuana and reduce the adverse effects of marijuana abuse.Keywords: Narcotics, Indonesia, Netherlands.Abstrak. Ganja merupakan salah satu jenis dari banyaknya narkotika yang sering disalahgunakan di Indonesia, Badan Narkotika Nasional (BNN) melaporkan bahwa ada sekitar dua juta pengguna ganja di Indonesia menjadikan ganja sebagai zat yang paling banyak digunakan di Indonesia. Belanda merupakan salah satu negara yang membiarkan penjualan ganja dalam jumlah kecil di coffeeshops sesuai dengan peraturannya yaitu Opium Art, namun menanam ganja dan menjualnya ke coffeeshop masih tergolong pelanggaran hukum. Bagi negara Belanda pengguna ganja bukan ancaman melainkan sumber pemasukan negara. Penggolongan ganja (Golongan I) dirasa sudah ketinggalan zaman dan memiliki dampak negatif bagi pelanggar hukum seperti pengguna dan petani ganja. Peranan pemerintah melalui lembaga negara dalam pemberantasan praktek peredaran ganja ilegal di Negara Indonesia dengan Negara Belanda sama-sama mempunyai peranan yang sangat penting. Akan tetapi Belanda lebih memilih untuk melegalkan ganja tersebut dalam jumlah tertentu dan regulasi yang ketat untuk mengurangi peredaran gelap dari ganja. Pemerintah Belanda dapat mengontrol secara langsung peredaran ganja dan mengurangi dampak buruk dari penyalahgunaan ganja.Kata Kunci: Narkotika, Indonesia, Belanda.
