Abstract. Nursing mothers and babies are the consumers who right to be guaranteed the convenience, security and safety in breastfeeding at public facilities in accordance with the regulations applied. The current research aimed to identify the regulation and its implementation concerning the provision of particular facilities for breastfeeding space in the shopping center of Bandung City in the case of consumers’ protection. The present research used normative juridical approach method, with research specification was analytical descriptive. The techniques used to collect the data were literature review, observation, and interview with the data sources that consist of primary, secondary and tertiary law materials. The data was analyzed and presented in qualitative normative. The research result showed that regulation concerning the provision of particular facilities for breastfeeding space was found in Laws, Government Regulation, Regulations of Health Ministry and Local Regulations. Those regulations was still in general, not covered the detail things that more technical. The implementation of provision of particular facilities for breastfeeding space physically have been conducted by the owner of shopping center business in Bandung City, but for the technical terms not completely referred to the regulations applied in this case the Regulation of Health Ministry and Local Regulations. The security and safety rights have been completed but still need to be supported by the implementation of the consumers’ convenience right.Key Terms: Consumers, Particular Facilities for Breastfeeding Space, Convenience Right, Security Right. Abstrak. Ibu menyusui dan anak adalah konsumen yang mempunyai hak untuk dijamin kenyamanan, keamanan dan keselamatannya menyusui di tempat sarana umum sesuai dengan peraturan yang berlaku. Penelitian ini bertujuan untuk mengetahui pengaturan dan implementasi terkait penyediaan fasilitas khusus ruang menyusui pada pusat perbelanjaan di kota Bandung dalam rangka perlindungan konsumen. Penelitian ini meggunakan metode pendekatan yuridis normatif, spesifikasi penelitian berfsifat deskriptif analitis. Teknik pengumpulan data studi kepustakaan, observasi dan wawancara dengan sumber data terdiri dari bahan hukum primer, sekunder, dan tersier. Dengan analisis dan penyajian data secara normatif kualitatif. Hasil penelitian menunjukan bahwa peraturan yang terkait dengan penyediaan fasilitas khusus ruang menyusui ditemukan dalam UU, PP, PERMENKES dan PERDA. peraturan-peraturan tersebut masih bersifat umum, belum mencakup hal-hal detail yang lebih teknis. Implementasi penyediaan fasilitas khusus ruang menyusui secara fisik sudah dilakukan oleh pelaku usaha pusat perbelanjaan di kota Bandung, tetapi untuk ketentuan-ketentuan teknis belum sepenuhnya mengacu kepada ketentuan yang berlaku dalam hal ini PERMENKES dan PERDA. Hak keamanan dan keselamatan sudah terpenuhi tetapi masih perlu didukung dengan pelaksanaan hak kenyamanan konsumen.Kata kunci: Konsumen, Fasilitas Khusus Ruang Menyusui, Hak Kenyamanan, Hak Keamanan. |
