Customary law is a complex of norms originating in the people's justice is always evolving and include the rules of human behavior in everyday life in the community, most of them are unwritten, but always adhered to and respected by the people, because it has legal consequences (sanctions). Customary law shows the pattern of motifs that does typern for Indonesia's traditional thoughts flow. Inheritance law contains rules governing the process forward items of property and goods that are the object of an intangible force human descendants form and system of law the heir is closely associated with the society and the nature of family. The form and the legal system of inheritance is closely associated with the society and the nature of family. In Indonesia, society in essence refers to the base of the system draws the line, as it is known in Indonesia, generally at least three known kinds of descent system that is Patrilineal system, Matrilineal System, and the system of Parental. In this thesis research the author will discuss about customary heirs of Bali. The system practised in Bali is patrilinial system which commonly known as system parusa. Here everything which is marriage, descent or inheritance all prefer men or give priority to draw the line descended from man. This fact distinguishes patrilinial system in Bali with patrilinial systems in other areas. The system is different with Bali patrilinial other areas as imbued by the Hindu religion. It is seen that in the patrilinial system in other areas of a woman is not feasible or not to continue the descent to the woman's father's family. Legal issues which will be discussed in this thesis research is about a woman's rights in inheritance system in particular in Bali customary and how the judicial system in Indonesia is disconnected things of the beneficiary heir, particularly Bali customary. The type of research used in this thesis is the juridical normative by examining materials library (study library). Therefore, the data used in this thesis is secondary data, which includes primary legal materials, legal secondary materials, and legal materials tertiary. |

Hukum Adat adalah suatu kompleks norma-norma yang bersumber pada keadilan rakyat yang selalu berkembang serta meliputi peraturan-peraturan tingkah laku manusia dalam kehidupan sehari-hari dalam masyarakat, sebagian besar tidak tertulis namun senantiasa ditaati dan dihormati oleh rakyat, karena mempunyai akibat hukum (sanksi). Hukum adat menunjukkan corak-corak yang memang typern bagi aliran pikiran tradisional Indonesia. Hukum adat waris memuat peraturan-peraturan yang mengatur proses meneruskan barang-barang harta benda dan barang-barang yang tidak berwujud benda dari suatu angkatan manusia keturunannya Bentuk dan sistem hukum waris sangat erat kaitannya dengan masyarakat dan sifat kekeluargaan. Pada masyarakat Indonesia, berpokok pada pangkal pada sistem menarik garis keturunan, seperti telah diketahui di Indonesia secara umum setidak-tidaknya dikenal tiga macam sistem keturunan yakni Sistem Patrilineal (bersifat kebapakan), Sistem Matrilineal (sifat keibuan), Sistem Parental (bersifat kebapak-ibuan). Pada penelitian ini penulis akan membahas mengenai waris adat Bali. Sistem yang dianut di Bali adalah sistem kekeluargaan patrilinial atau sistem kebapakan yang lazim disebut sistem parusa. Disini segala sesuatunya baik perkawinan, keturunan maupun pewarisan semuanya lebih mengutamakan laki-laki atau mengutamakan menarik garis keturunan dari laki-laki. Kenyataan ini yang membedakan sistem patrilinial di Bali dengan sistem patrilinial di daerah lain. Sistem patrilinial di Bali berbeda dengan daerah lain karena dijiwai oleh agama Hindu. Hal ini terlihat bahwa dalam sistem patrilinial di daerah lain seorang wanita tidak layak atau tidak meneruskan keturunan bagi keluarga ayah wanita tersebut. Permasalahan hukum yang akan dibahas dalam penelitian skripsi ini adalah mengenai hak seorang wanita secara sistem pewarisan adat Bali dan bagaimana sistem peradilan Indonesia dalam memutus perkara waris adat khususnya waris adat Bali. Jenis penelitian yang digunakan dalam skripsi ini adalah yuridis normatif dengan mengkaji bahan-bahan pustaka (studi kepustakaan). Oleh karena itu, data yang digunakan dalam skripsi ini adalah data sekunder, yang mencakup bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. |
