Abract, The inheritance law is the rule that governs the switching of rights and obligations of the heir to the heir, in the case of the law of the inheritance there is still a division of inheritance that is not in accordance with the provisions of the law in Indonesia, one of the heirs of Essentially the inheritance of the child outside the marriage does not always go smoothly, there are many cases of inheritance experienced by the family of blood with the child out of marriage, because the foreign child has not received recognition in the eyes of the law. Sdo cases of family inheritance Ida Nyoman Rai in Mataram, where 3 children outside marriage in the defendant by the blood relatives because of the uncommitted recognition by the customary law of Bali. This Research aims to determine the implementation of provisions and implementation of the child's inheritance outside of marriage based on the positive law in Indonesia. This Method of study uses a normative juridical approach with the analyst's DescriptiveResearch specification. Data collection Techniques are library studies and methods of analysis using qualitative juridical. The results of this research are the defendant or the child out of marriage entitled to get inheritance because the heir has already divided Boedel heirs fairly and legitimately. Keywords: Inheritance division, Child foreign marriage, Positive Law in IndonesiaABSTRAK, Hukum waris merupakan aturan yang mengatur peralihan hak dan kewajiban dari pewaris kepada ahli waris, dalam permasalahan hukum waris masih terdapat pembagian waris yang tidak sesuai dengan ketentuan hukum positif di Indonesia, salah satunya pembagian waris anak di luar kawin. Pada dasarnya pembagian waris anak di luar kawin tidak selalu berjalan lancar, banyak terjadi kasus pewarisan yang dialami oleh keluarga sedarah dengan anak luar kawin, karena anak luar kawin belum mendapatkan pengakuan di mata hukum. Seperti kasus pewarisan keluarga Ida Nyoman Rai di Mataram, dimana 3 anak di luar kawin di gugat oleh saudara sedarah karena belum dilakukan pengakuan oleh hukum adat Bali. Penelitian ini bertujuan untuk mengetahui implementasi ketentuan dan pelaksanaan pembagian waris anak di luar kawin berdasarkan hukum positif di Indonesia. Metode penelitian ini menggunakan pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analisis. Teknik pengumpulan data adalah studi kepustakaan dan metode analisis menggunakan yuridis kualitatif. Hasil penelitian ini ialah para tergugat atau anak luar kawin berhak mendapatkan warisan karena pewaris sudah membagi boedel waris secara adil dan sah.Kata Kunci : Pembagian Waris, Anak Luar Kawin, Hukum Positif Di Indonesia |
