Abstract.Fiqh Muamalah salam contract is one form of buying and selling in Islam which is carried out by sellers and buyers. Payment is made in advance at the time the contract and the goods are deferred or submitted later at the specified time. As for the specifications, the kinds, the quality must be clear and agreed upon at the beginning. Peace pillars are sellers and buyers, there are objects, there are sighats. The terms and conditions of the sale of greetings according to the agreement of the scholars there are five, namely the type of object of buying and selling greetings must be clear, the nature of the object of buying and selling greetings must be clear, the level or size of the object of buying and selling greetings must be clear, the time period of ordering the object of buying and selling greetings must be clear as for the practice of selling buying sand and stones at the Sumber Mulya Kejuden Building Store violates the terms of the salam agreement namely specifications because there is no dose between the sand and the stone it is feared that it will cancel the purchase agreement. The purpose of this research is to know muamalah fiqh review of the sale and purchase of sand orders. The results of the analysis of muamalah fiqh review agreement on the sale of stones and sand in the Sumber Mulya Kejuden store building are still not in accordance with the theory of fiqh muamalah salam agreement because there is one aspect that is not fulfilled, namely the specification of the lack of clarity of the dose between the stone and sand, but the other aspects are met such as the seller and buyer, the existence of the object, the contract is done, the payment is made at the beginning and the goods are deferred at the specified time, clearly the types, clearly the levels, clear types.Keywords: Purchase, bay-u salam, sand and stoneAbstrak. Fikih Muamalah akad salam adalah salah satu bentuk jual beli dalam islam yang dilakukan oleh penjual dan pembeli. Pembayarannya dilakukan di muka pada saat akad dan barangnya di tangguhkan atau di serahkan kemudian pada waktu yang di tentukan adapun spesiifikasi, macamnya, kualitasnya harus jelas dan di sepakati di awal.Rukun salam adalah penjual dan pembeli, ada objek, ada sighat (ijab dan qabul). Syarat jual beli salam menurut kesepakatan para ulama ada lima, yaitu jenis obyek jual beli salam harus jelas, sifat obyek jual beli salam harus jelas, kadar atau ukuran obyek jual beli salam harus jelas, jangka waktu pemesanan objek jual beli salam harus jelas adapun praktik jual beli pasir dan batu pada Toko Bangunan Sumber Mulya Kejuden menyalahi syarat akad salam yaitu spesifikasi karena tidak adanya takaran antara pasir dan batu tersebut dikhawatirkan akan membatalkan akad jual belinya. Adapun tujuan penelitiam ini adalah Untuk mengetahui tinjauan fikih muamalah terhadap jual beli pesanan pasir. Hasil analisis tinjauan fikih muamalah akad salam pada penjualan batu dan pasir di toko bangungan Sumber Mulya Kejuden masih belum sesuai dengan teori fikih muamalah akad salam dikarenakan ada 1 aspek yang tidak terpenuhi yaitu spesifikasinya tidak adanya kejelasan takaran antara batu dan pasirnya tetapi pada aspek yang lainnya terpenuhi seperti adanya penjual dan pembeli, adanya objek, dilakukannya akad, pembayaran di lakukan di awal dan barang di tangguhkan pada waktu yang di tentukan, jelas jenisnya, jelas kadarnya, jelas macamnya.Kata Kunci: Fikih muamalah akad salam, Jual beli, Pasir dan batu |
