abstract. Inheritance law in Indonesia is very diverse, it can be proven by the existence of three legal systems governing inheritance in effect in Indonesia, namely Inheritance Law according to Islamic Law, BW (Burgerlijk Wetboek), and Customary Law, inheritance is property left by the heir. for the heirs, whether the property has been divided or not. In this study, the aim of this research is to determine the implementation of the inheritance rights to the inheritance guaranteed according to Islamic law and BW law, as well as to know the legal protection of inheritance guaranteed according to Islamic law and BW law by using normative juridical research methods, namely methods that examine problems in society and the procedures that apply in society and certain situations.The inheritance can be owned by the heirs with the provisions of law and the presence of a will from the heir. If the heir does not make a will regarding the inheritance he left behind, the heirs can make a heir certificate at the sub-district office or before a notary. In this study, the problem is how the implementation of the rights of the heirs to the inheritance that is guaranteed according to Islamic Law and BW Law and how is the legal protection of inheritance guaranteed according to Islamic law and BW law.abstrak. Hukum waris di Indonesia sangat beraneka ragam hal tersebut dapat di buktikan dengan adanya tiga sistem hukum yang mengatur tentang kewarisan yang berlaku di Indonesia yakni Hukum Waris Menurut Hukum Islam, BW (Burgerlijk Wetboek), Dan Hukum Adat ,Harta warisan merupakan harta yang ditingalkan oleh pewaris untuk ahli waris nya, baik harta itu sudah di bagi atau belum terbagi. Dalam penelitian ini bertujuan untuk mengetahui implementasi Hak Para Ahli Waris Terhadap Harta Waris Yang Di Jaminkan menurut Hukum Islam Dan Hukum BW, serta mengetahui perlindungan hukum terhadap harta waris yang di jaminkan menurut Hukum Islam Dan Hukum BW dengan menggunakan metode penelitian yuridis normatif yakni metode yang mengkaji masalah-masalah dalam masyarakat dan tata cara yang berlaku dalam masyarakat serta situasi-situasi tertentu. Harta warisan dapat dimiliki oleh ahli waris dengan ketentuan undang-undang dan adanya wasiat dari pewaris. Jika pewaris tidak membuat wasiat tentang warisan yang di tingalkannya maka para ahli waris dapat membuat surat keterangan ahli waris di kantor kecamatan ataupun dihadapan notaris, Pada penelitian ini yang menjadi permasalahan ialah bagaimanakah implementasi hak para ahli waris terhadap harta waris yang di jaminkan menurut Hukum Islam Dan Hukum BW serta bagaimanakah perlindungan hukum terhadap harta waris yang di jaminkan menurut hukum Islam dan hukum BW. |
