Abstract. In labor law, an employment agreement is a form of protection for workers to guarantee the basic rights of workers, equal opportunities and treatment without discrimination. In the work agreement, conditions and rights of both parties are required to enter into a work relationship. Involvement between employers and workers / laborers makes the difference that workers who are not based on type, temporary activities can be agreed based on PKWT on a time period basis. Work protection for certain time workers must be improved as determined by the law regarding the period of validity of an employment agreement, so that workers / laborers are not disadvantaged by employers / companies.The research method used in this paper is the normative juridical approach. The type of data used is secondary data sourced from primary legal materials, secondary legal materials, and tertiary legal materials. The data collection technique used in this research is literature study, which is a data collection technique by studying secondary data.Based on the discussion of the results of the study note that the type of work that is the object of a certain time work agreement on the airline PT. X is not in accordance with the applicable laws and regulations, the term of the work agreement is not in accordance with the applicable laws and regulations, and some legal protection of workers' rights at PT. Di dalam hukum ketenagakerjaan, perjanjian kerja merupakan salah satu bentuk perlindungan terhadap tenaga kerja untuk menjamin hak-hak dasar pekerja, kesamaan kesempatan serta perlakuan tanpa diskriminasi. Di dalam perjanjian kerja diletakkan syarat-syarat ketentuan hak dan kewajiban kedua belah pihak untuk melakukan hubungan kerja. Keterlibatan antara pengusaha dan pekerja/buruh yang menimbulkan perbedaan bahwa pekerja yang tidak didasarkan pada jenis, kegiatan yang bersifat sementara dapat diperjanjikan berdasarkan PKWT atas dasar jangka waktu. Perlindungan kerja bagi pekerja waktu tertentu harus diperbaiki sebagaimana yang ditentukan oleh undang-undang mengenai jangka waktu berlakunya suatu perjanjian kerja, agar para pekerja/buruh tidak dirugikan oleh pihak pengusaha/perusahaan.Metode penelitian yang digunakan dalam penulisan ini adalah metode pendekatan yuridis normatif. Jenis data yang digunakan adalah data sekunder yang bersumber dari bahan hukum primer, bahan hukum sekunder, serta bahan hukum tersier. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah studi kepustakaan yaitu teknik pengumpulan data dengan mempelajari data sekunder.Berdasarkan pembahasan hasil penelitian diketahui bahwa jenis pekerjaan yang menjadi objek dalam perjanjian kerja waktu tertentu di maskapai penerbangan PT. X tidak sesuai dengan peraturan perundang-undangan yang berlaku, jangka waktu perjanjian kerja waktu tertentu tidak sesuai dengan peraturan perundang-undangan yang berlaku, dan sebagian perlindungan hukum terhadap hak pekerja di PT. X tidak sesuai dengan peraturan perundang-undangan yang berlaku.Kata Kunci: Pekerja, Perjanjian Kerja Waktu Tertentu (PKWT), Pemenuhan Hak Pekerja. |
