Abstract. In the electronic mortgage registration process, this can be done at the National Land Bandan Office. Registration of Mortgage Rights is regulated in two policies, namely the Law of Mortgage Number 4 of 1996 and Regulation of the Minister of Agrarian and Spatial Planning / National Land Agency Number 9 of 2019. In this case, the granting of Mortgage Rights electronically in which the Land Deed Making Officer is only tasked with submitting the Deed Granting Mortgage Rights and their files online and not registering Mortgage Rights at the Land Office. With the issuance of Permen ATR / BPN no.9 of 2019 that it is easier for PPAT to convey or register Mortgage Rights.The problem in this research is the extent to which the effectiveness of the application of the mortgage registration process and the five-day period in sending APHT and other documents from the Land Deed Making Official to the completion of the mortgage registration process at the Land Office online and legal consequences for creditor rights . The research objective is to know and understand the implementation of electronic mortgage registration faced by the Bandung City and Cimahi City National Land Agency Offices and to know and understand the registration arrangements and legal certainty of implementing Electronic Mortgage Registration by the Bandung City and Cimahi City Land Agency Offices.The research method used in the study is the Juridical-Normative method and uses literature data collection techniques using secondary data consisting of primary legal materials and secondary legal materials. The results obtained are the implementation of electronic mortgage registration at the National Land Agency Office in Bandung and Cimahi City. that PPAT has a big responsibility in the Mortgage registration process. In the period of registration of Mortgage Rights, it is often not on time and in the registration process there is an incomplete identity or incomplete documents of the parties. In this case the legal result of the inaccuracy of the registration process of the Mortgage Rights on the rights of creditors is normative, as long as the Certificate of Mortgage has not been issued, thus making the creditor position as a concurrent creditor. In this case the Land Office continues to process APHT until the Certificate of Mortgage Rights is issued as an effort to provide legal certainty for interested parties. Repeated violations by the PPAT result in the PPAT being only subject to administrative sanctions, namely a written warning.Abstrak. Abstrak. Pendaftaran Akata Dalam proses pendaftaran Hak Tanggungan secara Elektronik ini dapat di lakukan di Kantor Bandan Pertanahan Nasional. Pendaftaran Hak Tanggungan diatur dalam dua kebijkan ialah Undang-Undang Hak Tanggungan Nomor 4 Tahun 1996 serta Peraturam Menteri Agraria dan Tata Ruang/Badan Pertanahan Nasional Nomor 9 Tahun 2019. Delam hal ini pemberian Hak Tanggungan secara elektronik dimana Pejabat Pembuat Akta Tanah hanya bertugas menyampaikan Akta Pemberian Hak Tanggungan beserta berkasnya secara online dan tidak melakukan pendaftaran Hak Tanggungan di Kantor Pertanahan. Dengan di keluarkannya Permen ATR/BPN no.9 Tahun 2019 bahwa PPAT lebih mudah menyampaikan atau mendaftarkan Hak Tanggungan. Permasalahan di dalam penelitian ini adalah sejauh mana efektifitas pemberlakuan proses pendaftran Hak Tanggungan serta jangka waktu lima hari dalam pengiriman APHT dan warkah lain dari Pejabat Pembuat Akta Tanah sampai kepada proses penyelesaian pendaftaran Hak Tanggungan pada Kantor Pertanahan secara online dan akibat hukum terhadap hak-hak kreditor. Tujuan penelitian mengetahui dan memahami implementasi dalam pendaftaran Hak Tanggungan secara Elektronik yang dihadapi oleh Kantor Badan Pertanahan Nasional Kota Bandung dan Kota Cimahi serta mengetahui dan memahami pengaturan pendaftaran dan kepastian hukum pelaksanaan Pendaftaran Hak Tanggungan secara Elektronik oleh Kantor Badan Pertanahan Kota Bandung dan Kota Cimahi. Metode penelitian yang digunakan dalam penelitian adalah metode Yuridis-Normatif dan menggunakan teknik pengumpulan data secara kepustakaan dengan menggunakan data-data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Hasil penelitian yang diperoleh ialah implementasi dalam pendaftran Hak Tanggungan secara Elektronik di Kantor Badan Pertanhan Nasional Kota Bandung dan Kota Cimahi. bahwa PPAT mempunyai tanggungjawab yang besar dalam proses pendaftaran Hak Tanggungan. Dalam jangka waktu pendaftaran Hak Tanggungan sering kali tidak tepat waktu serta dalam proses pendaftaran terjadi kurang lengkapnya identitas atau kurang lengkapnya dokumen para pihak. Dalam hal ini akibat hukum ketidak tepatan waktu proses pendaftaran Hak Tanggungan terhadap hak-hak kreditor secara normatif, selama sertipikat Hak Tanggungan belum terbit, sehingga menjadikan kedudukan kreditor sebagai kreditor konkuren. Pada hal ini Kantor Pertanahan tetap memproses APHT sampai terbit Sertipikat Hak Tanggungan sebagai upaya kepastian hukum bagi pihak yang berkepentingan. Pelanggaran yang dilakukan berkali-kali oleh PPAT mengakibatkan PPAT yang bersangkutan hanya dikenai sanksi Administratif yaitu teguran tertulis. |
