Abstract. Medicine is one of the means or tools of prevention, cure and recovery of disease. Medicines in Indonesia are divided into several types, namely Free Medicines, Limited Free Medicines, Hard Drugs, and Narcotics. Regarding drugs for the hard drug class, namely drugs that are not used for technical purposes which have the property of treating, strengthening, sanitizing, disinfecting, etc. the human body, whether in packaging or not. Actually, this hard drug cannot be bought and sold freely without a doctor's prescription or a special order letter. But unfortunately, nowadays the sale and purchase of hard drugs freely are taking place, especially via online. Based on this phenomenon, the problems in this study are formulated as follows: (1) how is the legitimacy of the sale of drugs for the class of drugs online as far as Jo's Civil Code. Law Number 19 of 2016 concerning ITE ?; (2) what is the seller's legal responsibility for the sale of hard drugs online according to Law Number 36 of 2009 concerning Health? Researchers used a normative legal approach with analytical descriptive character. The data collection technique used by researchers was direct interviews with pharmacists in a semi-structured manner and also interviews with individual users and sellers of hard drugs. Then the researcher also uses library research to complement the research results. The results of this study are: (1) The classes of hard drugs sold in pharmacies are divided into several ingredients, such as Psychotropics and Precursors. (2) Drugs classified as hard drugs may not be sold freely without a doctor's prescription or a special order letter. (3) Hard drugs that are sold freely in the market are due to the term discarded goods sold by Sub Distributors or third parties without a doctor's prescription. (4) One type of hard drug that is sold freely in online media, namely Excimer.Abstrak. Obat merupakan salah satu sarana atau alat dari pencegahan, penyembuhan, dan pemulihan penyakit. Obat-obatan di Indonesia dibedakan dalam beberapa jenis, yaitu Obat Bebas, Obat Bebas Terbatas, Obat Keras, dan Narkotika. Terkait obat golongan obat keras yaitu obat-obatan yang tidak digunakan untuk keperluan teknik yang mempunyai khasiat mengobati, menguatkan, membaguskan, mendesinfeksikan, dan lain-lain tubuh manusia, baik dalam kemasan maupun tidak. Sebenarnya, obat keras ini tidak dapat diperjual belikan secara bebas tanpa resep dokter atau Surat Pesanan Khusus. Namun sayangnya, sekarang ini transaksi jual beli obat keras secara bebas marak terjadi khususnya melalui via online. Berdasarkan fenomena tersebut, maka permasalahan dalam penelitian ini dirumuskan sebagai berikut: (1) bagaimana keabsahan penjualan obat-obatan golongan obat keras secara online ditinjauh Kitab Undang-Undang Hukum Perdata Jo. Undang-Undang Nomor 19 Tahun 2016 tentang ITE?; (2) bagaimana tanggung jawab hukum penjual atas penjualan obat-obatan golongan obat keras secara online menurut Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan? Peneliti menggunakan metode pendekatan hukum normatif dengan bersifat deskriptif analitis. Teknik pengumpulan data yang digunakan oleh peneliti yaitu dengan cara wawancara langsung dengan apoteker secara semi terstuktur dan juga wawancara terhadap oknum pengguna dan penjual obat keras. Kemudian peneliti juga menggunakan penelitian pustaka guna melengkapi hasil penelitian. Hasil dari penelitian ini adalah: (1) Golongan obat keras yang terjual di Apotek dibagi dalam beberapa kandungan, seperti Psikotropika dan Prekursor. (2) Obat golongan obat keras tidak boleh dijual bebas tanpa resep dokter atau Surat Pesanan Khusus. (3) Obat keras yang terjual bebas di pasaran dikarenakan adanya istilah barang-barang buangan yang dijual oleh Sub Distributor atau pihak ketiga tanpa resep dokter. (4) Salah satu jenis obat keras yang terjual bebas di media online, yaitu Excimer.
