Abstract. Freedom of expression, opinion, freedom of information is the task of the press in carrying out its journalistic activities, freedom of the press is part of freedom of expression, expressing thoughts and opinions according to conscience. A journalist with a journalistic code of ethics carries out his duties in accordance with limiting good and bad things to be reported, legal protection of press freedom is still a question because there is still only a journalist who was sentenced to a criminal sentence for his reporting without going through a process mechanism dispute resolution in advance to fulfill the right of reply and right of correction in accordance with Law Number 40 of 1999 concerning the Press. The role of the Press Council in handling issues of press reporting can be used as an intermediary in dispute resolution. The purpose of this research is to find out the process of resolving the secretariat and the function of the press council in dealing with the mass media reporting as well as to find out aspects of criminal law in the mechanism of resolving press disputes. This approach method, is a normative juridical approach, If a dispute arises as a result of press reporting, it should be settled in accordance with the provisions in Law Number 40 of 1999 concerning the Press to fulfill the right of reply and right of correction, because a journalist cannot be sentenced to a criminal sentence for the reporting he made. Because the press company has been appointed responsible for covering the business and editorial fields.Keywords: Freedom of the Press, Journalism, the Press Council, Responsible Answer.Abstrak. Kebebasan berekspresi, berpendapat, kebebasan informasi merupakan tugas pers dalam melakukan kegiatan jurnalistiknya, kebebasan pers bagian dari kebebasan berekspersi, menyatakan pikiran dan pendapat sesuai hati nurani. Seorang jurnalis dengan kode etik jurnalistik menjalankan tugasnya sesuai dengan membatasi hal-hal yang baik dan hal-hal yang tidak baik untuk diberitakan, perlindungan hukum terhadap kebebasan pers masih menjadi petanyaan karena masih ada saja seorang jurnalis yang dijatuhi hukuman pidana karena pemberitaanya tanpa melalui mekanisme proses penyelesaian sengketa terlebih dahulu untuk memenuhi hak jawab dan hak koreksi sesuai dengan Undang-Undang Nomor 40 Tahun 1999 Tentang Pers. Peran Dewan pers dalam penanganan permasalahan pemberitaan pers bisa dijadikan sebagai penengah dalam penyelesaian sengketa. Tujuan penelitian ini, untuk mengetahui proses penyelesaiyan sekngketa dan fungsi dewan pers dalam malasah akibat pemeberitaan media massa juga untuk mengetahui aspek hukum pidana dalam mekanisme penyelesaian sengketa pers. Metode pendekatan ini, adalah pendekatan yuridis normatif. Apabila terjadi sengketa akibat pemberitaan pers seharusnya diselesaikan sesuai dengan ketentuan didalam Undang-Undang Nomor 40 Tahun 1999 Tentang Pers untuk pemenuhan hak jawab dan hak koreksi, karena seorang jurnalis tidak bisa dijatuhi hukuman pidana atas pemberitaan yang dibuatnya. Karena dalam perusahaan pers sudah ditunjuk penaggung jawab yang meliputi bidang usaha dan bidang redaksi.Kata Kunci: Kebebasan Pers, Jurnalistik, Dewan Pers, Pertanggungawaban. |
