Abstract. Workers in the business world have an important role in the activities that take place in the company. The relationship between workers and companies is bound by a work agreement, which is based on Law Number 13 of 2003 concerning Manpower. However, many companies still have not fulfilled the rights of workers in accordance with the laws and regulations and work agreements, especially in terms of termination of employment. Such as termination of employment by PT. Beka in Pelalawan Regency, which do not comply with procedures and do not comply with workers' rights due to termination of employment. The legal issue raised in this case is the guarantee of the implementation of workers' rights due to termination of employment. The results showed that the termination of employment by PT. Beka has violated the provisions stipulated in Company Regulations and Employment Agreements, namely guarantees of the implementation of workers' rights due to termination of employment, which PT. Beka so that PT. Beka violated the provisions stipulated in Article 156 paragraph (1) of Law Number 13 Year 2003 concerning Manpower. Therefore, the purpose of law in fulfilling the elements, protection, certainty, justice and legal benefits has not been fully realized in this case. Abstrak. Tenaga kerja dalam dunia usaha mempunyai peranan penting dalam kegiatan yang berlangsung di perusahaan. Hubungan pekerja dengan perusahaan diikat oleh perjanjian kerja, yang berdasarkan pada Undang-undang Nomor 13 tahun 2003 tentang Ketenagakerjaan. Namun banyak perusahaan masih belum memenuhi hak-hak pekerja yang sesuai dengan peraturan perundangan-undangan dan perjanjian kerja tersebut, khususnya dalam hal pemutusan hubungan kerja. Seperti pemutusan hubungan kerja yang dilakukan oleh PT. Beka di Kabupaten Pelalawan, yang tidak sesuai prosedur dan tidak memuhi hak-hak pekerja akibat Pemutusan Hubungan Kerja. Permasalahan hukum yang diangkat dalam kasus ini ialah jaminan pelaksanaan hak-hak pekerja akibat pemutusan hubungan kerja. Hasil penelitian menunjukkan bahwa pemutusan hubungan kerja yang dilakukan oleh PT. Beka telah melakukan pelanggaran terhadap ketentuan yang diatur dalam Peraturan Perusahaan dan Perjanjian Kerja, yitu jaminan pelaksanaan hak-hak pekerja akibat Pemutusan Hubungan Kerja, tidak dipenuhi oleh PT. Beka sehingga PT. Beka melanggar ketentuan yang diatur dalam pasal 156 ayat (1) Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Oleh sebab itu tujuan hukum dalam pemenuhan unsur, perlindungan, kepastian, keadilan serta kemanfaatan hukum belum terwujud sepenuhnya dalam kasus ini. |
