The Compilation of Islamic Law was formed on the consideration that the judiciary is already very old, while the judge does not have the standard reference books together, such as the Criminal Code. As a result, when the judges hear the case, the reference is books of fiqh without standardization or uniformity. It goes, it is practically possible to be born different verdict for similar cases for handling by different judges. In addition, since the judiciary in Indonesia, the need for the Compilation of Islamic Law is already being felt. This purpose is never lost, even growing steadily in line with the development of the judiciary. With the enactment of Law 7 of 1989, the need for the compilation of Islamic law is filled with the issuance of Presidential Instruction Number 1 of 1991. It was followed up by the decision of the Minister of Religion number 154 of 1991 on exercising Presidential Decree number 1 of 1991 regarding the dissemination of the compilation of Islamic law. Wasiat wajibah can also be interpreted as a mandatory provision to heirs or the family especially the grandchildren are blocked from receiving wasiat property because their mother or father grandparents died before they die or die together. This is because they are hindered by legal heirs inherit the legacy of his grandparents because no heir uncle or aunt to grandchildren. The compilation of Islamic Law (KHI) is the provision of an object from the heir to other persons or institutions that take effect after the testator dies. The method used is normative. Dibentuknya KHI adalah karena melihat peradilan sudah berusia sangat lama sedangkan hakimnya tidak memiliki buku standar yang menjadi rujukan bersama seperti KUHP. Ini berakibat bahwa jika para hakim menerima kasus yang harus diadili maka yang menjadi rujukannya adalah beberapa buku fiqih secara langsung tanpa sesuatu standarisasi atau keseragaman. Akibat lanjutannya, secara praktis terhadap kasus-kasus yang sama dapat lahir putusan yang berbeda jika ditangani oleh hakim yang berbeda. Lain daripada itu, sejak adanya peradilan di Indonesia, keperluan akan adanya Kompilasi Hukum Islam sudah dirasakan. Keputusan ini tidak perna hilang, bahkan berkembang terus sejalan dengan perkembangan badan peradilan sendiri. Dengan diundangkannya undang-undang No. 7 tahun 1989 maka keperluan akan adanya kompilasi hukum Islam dipenuhi dengan dikeluarkannya instruksi Presiden No. 1 tahun 1991, yang kemudian ditindaklanjuti dengan keputusan Mentri Agama No. 154 tahun 1991 tentang pelakasanaan Inpres No. 1 tahun 1991 mengenai penyebarluasan kompilasi hukum Islam. Wasiat wajibah juga dapat diartikan sebagai suatu pemberian yang wajib kepada ahli waris atau kaum keluarga terutama cucu yang terhalang dari menerima harta warsian karena ibu atau ayah mereka meninggal sebelum kakek atau nenek mereka meninggal atau meninggal bersamaan. Ini karena berdasarkan hukum waris  mereka terhalang dari mendapat bagian harta peninggalan kakek dan neneknya karena ada ahli waris paman atau bibi kepada cucu tersebut. Adapun dalam kompilasi Hukum islam (KHI) yaitu pemberian suatu benda dari pewaris kepada orang lain atau lembaga yang berlaku setelah pewaris meninggal dunia. Metode penelitian yang digunakan adalah yuridis normatif. Untuk mengkaji permasalahan di atas maka diadakan teknik pengumpulan data secara kepustakaan, dengan mengadakan penelaahan terhadap buku-buku, literatur-literatur, al-Qur’an, hadis, kitab-kitab fiqih, dan kitab Undang-Undang. Wasiat wajibah juga dapat diartikan sebagai suatu pemberian yang wajib kepada ahli waris atau kaum keluarga terutama cucu yang terhalang dari menerima harta warsian karena ibu atau ayah mereka meninggal sebelum kakek atau nenek mereka meninggal atau meninggal bersamaan. Ini karena berdasarkan hukum waris  mereka terhalang dari mendapat bagian harta peninggalan kakek dan neneknya karena ada ahli waris paman atau bibi kepada cucu tersebut. Adapun dalam kompilasi Hukum islam (KHI) yaitu pemberian suatu benda dari pewaris kepada orang lain atau lembaga yang berlaku setelah pewaris meninggal dunia. Adapun orang yang mendapatkan wasiat wajibah disini yaitu para ahli waris yang tidak mendapatkan bagian harta waris. Dan orang yang tidak mendapatkan wasiat wajibah yaitu para ahli waris yang mendapatkan harta warisan, karena pada dasarnya orang yang sudah mendapatkan bagian warisan tidak boleh mendapatkan bagian lainnya atau mendapatkan dua bagian dalam kewarisan.
