Abstract. Islam has provided rules that covers harmony, terms and forms that are prohibited or permitted in business matters unless there is a argument that prohibits it. But often in the field practice, there are unaccordance salary with the provisions in fiqh muamalah namely the unilateral deduction of wages, which is harm one party. The research in this paper was conducted at Home Industry Triple A in Bogor Regency. The aim of this study was to find out how the Home Industry Triple A waging system in Bogor Regency in improving worker welfare reviewed from the fiqh perspective, it was at Home Industry Triple A in Bogor Regency. The method that used in this resear are Qualitative research, and data collection using Field Research (field) research. Data collection techniques are by observation, documentation and interviews, data techniques analysis using normative juridical. The results of the study found that the wages received by workers are often not in accordance with the agreement at the beginning of the work, there are salary deductions that are not discussed to workers. It should be in the case between investors and workers that they had to use any conditions that have been set by the principles and rights of fiqh muamalah, that is they must use the basic principle of "likes and likes". While the amount of wages in increasing the welfare of workers is categorized as not meeting the minimum of welfare of workers. Because remuneration at Home Industry Triple A in Bogor Regency is still far from the Regency Minimum Wage (UMK) which is a measure of welfare.Keywords: Wages, Welfare, Home Industry Triple AAbstrak. Islam telah memberikan aturan meliputi rukun syarat dan bentuk bermuamalah yang dilarang ataupun yang diperbolehkan. Namun sering kali pada praktek di lapangan terdapat pengupahan yang tidak sesuai dengan ketentuan didalam fikih muamalah, sehingga hal ini dapat merugikan salah satu pihak. Di Home Industry Triple A terdapat adanya permasalahan dalam pemotongan upah secara sepihak tidak didiskusikan terlebih dahulu kepada pekerja. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana sistem pengupahan pekerja Home Industry Triple A di Kabaputen Bogor, untuk mengetahui sistem upah dalam meningkatkan kesejahteraan pekerja di tinjau dari perspektif fikih muamalah di Home Industry Triple A di Kabupaten Bogor. Metode yang digunakan dalam penelitian ini adalah metode kualitatif dengan pendekatan studi kasus dan jenis penelitian lapangan (field research). Pengumpulan data dilakukan dengan wawancara, observasi dan dokumentasi. Hasil dari penelitian ditemukan upah yang diterima oleh pekerja sering kali tidak sesuai dengan perjanjian diawal kerja terdapat adanya pemotongan gaji yang tidak didiskusikan dahulu kepada pekerja. Seharusnya dalam bermuamalah antara pemilik modal dan pekerja harus menggunakan ketentuan apa saja yang telah ditetapkan oleh prinsip dan hak fikih muamalah yaitu harus menggunakan prinsip dasar “suka sama suka”. Sementara besaran upah dalam meningkatkan kesejahteraan pekerja dikategorikan belum memenuhi tingkat kesejahteraan para pekerja. Karena pengupahan di Home Industry Triple A di Kabupaten Bogor masih jauh dari Upah Minimum Kabupaten (UMK) yang menjadi tolak ukur kesejahteraan.Kata Kunci : Pengupahan, Kesejahteraan, Home Industry Triple A |
