Abstract. The presence of the Internet has a positive impact also gives a negative impact, in addition to facilitate consumers to watch the movie, the development will also open opportunities for irresponsible parties to make the announcement and duplication of the film without permission from the copyright holder. One of the implications of information technology that is currently a concern is its influence on the existence of Intellectual Property Rights, in addition to other fields such as business transactions (e-commerce), e-government activities, to the spread of films without permission of the copyright holder into the internet site. Responding to the development of information technology in the enjoyment of films raises the problem of sites that provide access to streaming movies for free, pursuant to Article 40 paragraph (1) letter m, film or cinematography is one of the objects protected by copyright. Although from the perspective of legal acts by streaming movie sites is a violation, but in fact these sites are still free to run these activities. The investigator cannot conduct an investigation without any complaints from the aggrieved party. From this, it’s necessary to examine how law protection for copyright holders of unlicensed streaming and unauthorized copying of the movie on the internet pursuant to Law No. 28 of 2014 on Copyright and how the role of government administration in overcoming copyright infringement of films done by unlimited streaming video sites. The research method used in this writing is normative juridical and research specification used is descriptive analysis. The analytical technique used by the author is Normative Qualitative. As well as data collection techniques used in this research is literature study, to collect secondary data by studying the concepts, theories or regulations or policies that apply and is closely related to the subject matter. From the analysis obtained in Article 9 paragraph (2) of the Copyright Act any person exercising the economic rights of a work shall obtain permission from the creator or copyright holder, this proves that the practice undertaken by the free streaming film site is Copyright infringement. Efforts taken by the government in dealing with such violations are to partially or completely close the site and the user's access rights to the site, the participation of the copyright holder of the film to carry out the complaint in the investigation.Keywords: Legal Protection, Film Copyrights Abstrak. Hadirnya Internet menimbulkan dampak positif juga memberi dampak negatif, disamping memudahkan konsumen untuk menonton film, perkembangan tersebut juga akan membuka peluang bagi pihak yang tidak bertanggung jawab untuk melakukan pengumuman dan penggandaan film tanpa ada izin dari pemegang hak cipta. Salah satu implikasi teknologi informasi yang saat ini menjadi perhatian adalah pengaruhnya terhadap eksistensi HKI, disamping terhadap bidang-bidang lain seperti transaksi bisnis (elektronik), kegiatan e-government, hingga penyebaran film tanpa izin pemegang hak cipta ke dalam situs internet. Menanggapi perkembangan teknologi informasi dalam menikmati film menimbulkan permasalahan adanya situs yang memberikan akses streaming film secara gratis, berdasarkan Pasal 40 ayat (1) huruf m film atau sinematografi itu merupakan salah satu objek yang dilindungi oleh hak cipta. Meskipun dari perspektif perbuatan hukum yang dilakukan situs film streaming adalah pelanggaran, tetapi kenyataannya situs-situs tersebut masih bebas menjalankan kegiatan tersebut. Penyidik tidak dapat melakukan penyidikan tanpa adanya pengaduan dari pihak yang dirugikan. Dari hal tersebut, maka perlu dikaji mengenai bagaimana perlindungan hukum bagi pemegang hak cipta film atas pengumuman dan penggandaan film streaming tanpa izin di internet berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan bagaimana peran administrasi pemerintah dalam menanggulangi pelanggaran hak cipta atas film yang dilakukan oleh situs fim streaming tanpa izin. Metode penelitian yang digunakan dalam penulisan ini ialah yuridis normatif dan spesifikasi penelitian yang digunakan ialah deskriptif analisis. Teknik analisis yang digunakan Penulis ialah Normatif Kualitatif. Serta teknik pengumpulan data yang di gunakan dalam penelitian ini adalah studi kepustakaan, untuk mengumpulkan data sekunder dengan cara mempelajari konsep-konsep, teori-teori atau peraturan atau kebijakan-kebijakan yang berlaku dan berhubungan erat dengan pokok permasalahan. Dari hasil analisis yang didapatkan dalam Pasal 9 ayat (2) Undang-Undang Hak Cipta setiap orang yang melaksanakan hak ekonomi dari suatu ciptaan wajib mendapatkan izin dari pencipta atau pemegang hak cipta, hal ini membuktikan bahwa praktek yang dilakukan oleh situs streaming film gratis tersebut merupakan pelanggaran Hak Cipta. Upaya yang dilakukan oleh pemerintah dalam menanggulangi pelanggaran tersebut adalah melakukan penutupan sebagian atau seluruh situs dan hak akses pengguna terhadap situs tersebut, diperlukan partisipasi pemegang hak cipta film untuk melaksanakan delik aduan dalam penyelidikan.Kata Kunci: Perlindungan Hukum, Hak Cipta Film |
