Abstract. Technology today cannot be denied is developed very rapidly. One form of these rapid technology development that is currently being discussed and massively utilised is the presence of online-based application transportation. However, this technological advance still have a gap to be cheated by irresponsible people who want to earn money by breaking the rules through modifying android handphone (HP root). Thus, they do not have to bother driving to pick up passengers from place of origin to destination by onlinely. Incentives are obtained, something that can only be legally obtained with certain targets of a company with considerable revenue. The arrangement relating to this fictitious order is Law No. 11 of 2008 concerning Information on Electronic Transactions. The method used is the normative research method in concreto, because in this study the researcher wanted to find out whether the law applied was appropriate to solve the case or problem in this case. One of the cases of fictitious online transportation was in Makassar by Muh Fadhiel Ramadhan and Muhammad Erick Kurniawan. Based on the results, it can be concluded that the factors that caused the perpetrators to commit fictitious order crimes against Online Transportation by using an android mobile application on social media, namely the pursuit of daily targets, and the high competition between online motorcycle taxi drivers.Keyword: Online Transportation, Driver, Law and Social Media, Fictional Order Crime.Abstrak. Teknologi saat ini tidak dapat disangkal dikembangkan dengan sangat cepat. Satu bentuk perkembangan teknologi cepat yang saat ini sedang yang dibahas dan dimanfaatkan secara luas adalah keberadaan berbasis online transportasi aplikasi. Namun, kemajuan teknologi ini masih ada celah untuk ditipu oleh orang yang tidak bertanggung jawab yang mau dapatkan uang dengan melanggar aturan melalui memodifikasi android handphone (HP root). Dengan demikian, mereka tidak perlu repot mengemudi jemput penumpang dari tempat asal ke tujuan secara online. Dengan cara ini, insentif diperoleh, sesuatu yang hanya dapat diperoleh secara hukum dengan target tertentu dari perusahaan dengan pendapatan yang cukup besar. Pengaturan yang berkaitan dengan orderan fiktif ini adalah Undang-Undang No. 11 Tahun 2008 Tentang Informasi Transaksi Elektronik. Metode yang digunakan adalah metode penelitian normative in concreto, karena dalam penelitian ini peneliti ingin menemukan apakah hukum yang diterapkan telah sesuai untuk menyelesaikan perkara atau masalah dalam perkara ini. Kasus orderan fiktif transportasi online salah satunya terjadi di Makassar oleh Muh Fadhiel Ramadhan dan Muhammad Erick Kurniawan. Berdasarkan hasil penelitian, dapat disimpulkan bahwa faktor yang menjadi penyebab pelaku melakukan Kejahatan orderan fiktif terhadap Transportasi Online dengan menggunakan aplikasi handphone android dalam media sosial, yaitu kejar target harian, dan tingginya persaingan antar driver ojek online.Kata Kunci: Transportasi Online, Pengemudi, Hukum dan Media Sosial, Kejahatan Orderan Fiktif. |
