Marriage is a marriage according to Islamic law, which is a very strong contract or mistaqon gholidzhon to obey the commands of Allah SAW and worship. For followers of Islam the marriage can be said to be valid if they are eligible and harmonious marriage under Islamic law. One of the conditions a legal marriage is performed by a man and a woman. In Islam the same-sex marriage would not be allowed, but there are some people who want to do it, and some are of the opinion that same-sex marriage are Human Rights. In this paper the author will discuss about the factors that cause the same-sex marriage and same-sex marriage in terms of the perspective of Positive Law and Islamic Law. The method used is normative, i.e. by trying to assess and examine the data relating to the issue of same-sex marriage. Data collection techniques from the research done by studies document that is studying the documents contained in the materials primary law and secondary law, as well as conducting interviews with sources related to the matter. Perkawinan menurut Hukum Islam adalah pernikahan, yaitu akad yang sangat kuat atau mistaqon gholidzhon untuk menaati perintah Allah SAW dan melaksanakanya merupakan ibadah. Bagi pemeluk Agama Islam perkawinannya dapat dikatakan sah apabila memenuhi syarat dan rukun perkawinan menurut Hukum Islam. Salah satu syarat perkawinan yang sah adalah dilakukan oleh seorang pria dan wanita. Dalam Islam perkawinan sesama jenis tentu tidak diperbolehkan, namun ada sebagian masyarakat yang ingin melakukanya, dan ada pula yang berpendapat bahwa perkawinan sesama jenis adalah Hak Asasi Manusia. Dalam skripsi ini penulis akan membahas tentang faktor-faktor penyebab perkawinan sesama jenis dan perkawinan sesama jenis ditinjau dari Hukum Positif dan perspektif Hukum Islam. Metode pendekatan yang digunakan adalah yuridis normatif, yaitu dengan berusaha mengkaji dan menguji data yang berkaitan dengan masalah perkawinan sesama jenis. Teknik pengumpulan data dari penelitian ini dilakukan dengan cara studi dokumen yaitu mempelajari dokumen-dokumen yang terdapat dalam bahan hukum primer dan bahan hukum sekunder, serta melakukan wawancara dengan narasumber yang terkait dengan masalah tersebut. Perkawinan sesama jenis adalah tidak sah menurut Hukum Islam dan Undang-Undang No.1 Tahun 1974 Tentang Perkawinan. Karena bertentangan dengan syarat-syarat sahnya perkawinan dan norma-norma Agama. |
