Abstract. The 1945 Constitution of the Republic of Indonesia. Countries that adhere to the principle of trias politics, regulate matters that are necessary. The DPR which is part of the legislative power is the embodiment of the people. Then 1. Is it as an embodiment of the people, the DPR needs a form of legal protection (immunity) in carrying out its duties as a people's representative. And 2. Does the right of immunity or legal immunity apply to the DPR if it commits a crime. The purpose of this reform is the right to immunity that is rightly attached to members of the DPR and also members of the DPR who are entitled to immunity in the case of acts of violence. This research uses the normative juridical method. In this study the subject of literature or secondary data is to search for regulations, norms, basic methods, jurisprudence and the doctrine and discussion of experts relating to what is discussed about the right to immunity. The immunity rights of legislators regulate in Law Number 2 of 2018 concerning MD3 as well as Law Number 17 of 2014, where DPR members receive special assistance in carrying out their functions and duties as people's representatives, and against DPR members who carry out their duties without protection from the right of immunity.Keywords: Immunity rights, members of the DPR, the rule of law Abstrak. Indonesia adalah negara yang berdasarkan atas hukum (Rechtsstaat), hal itu dinyatakan dengan jelas dalam Pasal 1 Ayat (3) Undang-Undang Dasar Republik Indonesia tahun 1945. Sebagai negara yang menganut prinsip trias politika dimana pembagian kekuasaan menjadi hal yang niscaya. DPR yang merupakan bagian dari kekuasaan legislatif adalah perwujudan dari rakyat.maka 1. Apakah sebagai perwujudan dari rakyat, DPR membutuhkan suatu bentuk perlindungan hukum (imunitas) dalam menjalankan tugasnya sebagai wakil rakyat. Dan 2. Apakah hak imunitas atau kekebalan hukum itu berlaku bagi DPR jika melakukan tindak pidana. Yang menjadi tujuan penulisan ini adalah apakah hak imunitas tepat dilekatkan untuk anggota DPR serta apakah tepat anggota DPR mempunyai hak imunitas dalam hal tindak pidana. Penelitian ini menggunakan metode yuridis normatif. Pada penelitian ini yang diteliti adalah bahan pustaka atau data sekunder dengan cara mengadakan penelusuran terhadap peraturan-peraturan perundang-undangan, norma , kaedah dasar,yurisprudensi serta doktrin dan pendapat para ahli yang berkaitan dengan permasalahan yang diteliti mengenai hak imunitas. Hak imunitas anggota legislatif diatur didalam Undang-undang Nomor 2 Tahun 2018 Tentang MD3 serta Undang-undang Nomor 17 Tahun 2014, dimana anggota DPR mendapat perlakuan khusus dalam menjalankan fungsi dan tugasnya sebagai wakil rakyat, dan terhadap perbuatan anggota DPR yang dilakukan diluar tugasnya tidak mendapat perlindungan dari hak imunitas tersebut.Kata Kunci : Hak imunitas, anggota DPR, Negara hukum |
