Abstract. Nowadays in communities around the globe are often found buying and selling with pre order or order systems. In your mind, this is called istishna. The product product product on the yazl factory in a custom-made delivery system has become a tradition of what he has ordered. If a reservation takes place and the consumer canceled the order, then the down payment could become the consumer's again and some of the seller's. The purpose of this study is to know the stipulations of down payment in pre-order according to islamic law and positive law on pre-order transactions in what is now controlled yazl product.The research method used is a descriptive qualitative method. The research source is the primary data results from interviews with the proprietor of product yazl and secondary data from the associated book or journal. The data-gathering technique used was interviews and literature studies. The results of the study indicate that there is a discrepability between a down view according to islamic law anda positive law that applies to the practice of executing money on product yazl luggage. |
