Abstract. Facebook's group facilities are very helpful in buying and selling transactions, including one of the auctions, which among them occur in the Indo Gamer Auction Group. But sometimes there are unscrupulous buyers (bidders) who refuse or do not answer messages sent by the seller (auctioneer). This event is commonly called the bid and run, where the buyer refuses to pay for the goods or runs away from the responsibility for the auctioned goods he won. The practice of bid and run can be detrimental to one party, namely the seller, which basically in the sale and purchase may not harm either party. Thus, the identification of the problem that the authors take is how the theory of bai 'muzayadah (auction) according to Islam, how the practice of buying and selling at auction in the Indo Gamer Facebook group, how to review bai' muzayadah on the practice of bid and run auctions in the Indo Gamer Facebook group. The purpose of identifying the problem above is to understand the bai muzayyadah theory, to know and understand the practice of buying and selling auction in the Indo Gamer Facebook group, and to know and understand the bai 'muzayadah review of the bid and run auction practice on the Indo Gamer Facebook group. In order to answer the questions above, the author uses data collection techniques. The data collected in this study is data that has been obtained during the study by studying books relating to issues and interviews with several parties involved in the Indo Gamer Auction Group. The results of the study were then examined using descriptive verification techniques with an inductive mindset, this mindset is used to analyze specific data based on the facts of the research results then general conclusions are drawn. The results of this study explained that in the practice of online auctions in the Indo Gamer Auction Group on Facebook, the terms and conditions of the sale and purchase of the auction were not fulfilled in the contract meeting, because of the practice of bid and run from buyers who clearly betrayed the contract agreement agreed in the auction, and this also can result in the non-fulfillment of the principle of an-taradhin (the pleasure of the two parties to the transaction) in the sale and purchase.Keywords: Auction, Facebook, Bai MuzayyadahAbstrak. Fasilitas group yang dimiliki Facebook sangat membantu transaksi jual beli, termasuk salah satunya lelang, yang mana diantaranya terjadi dalam Grup Lelang Indo Gamer. Akan tetapi terkadang terdapat oknum pembeli (bidder) yang menolak atau tidak menjawab pesan yang dikirimkan oleh penjual (auctioneer). Kejadian ini biasa disebut bid and run, dimana pembeli menolak membayar barang atau kabur dari tanggung jawab terhadap barang lelang yang dimenangkannya. Praktik bid and run ini dapat merugikan salah satu pihak yaitu penjual, yang mana pada dasarnya dalam jual beli tidak boleh merugikan salah satu pihak. Dengan demikian, identifikasi masalah yang penulis ambil adalah bagaimana teori bai’ muzayadah (lelang) menurut Islam, bagaimana praktik jual beli secara lelang di group Facebook Indo Gamer, bagaimana tinjauan bai’ muzayadah terhadap praktik bid and run lelang di group Facebook Indo Gamer. Adapun tujuan dari identifikasi masalah di atas ialah untuk memahami teori bai muzayyadah, mengetahui dan memahami praktik jual beli secara Lelang di group Facebook Indo Gamer, dan untuk mengetahui dan memahami tinjauan bai’ muzayadah terhadap praktik bid and run lelang di group Facebook Indo Gamer. Guna menjawab pertanyaan di atas, penulis menggunakan teknik pengumpulan data. Data yang dikumpulkan dalam penelitian ini adalah data yang telah diperoleh selama penelitian dengan cara mempelajari buku-buku yang berkaitan dengan permasalahan dan wawancara dengan beberapa pihak yang terlibat dalam Grup Lelang Indo Gamer. Hasil penelitian itu kemudian ditelaah dengan menggunakan teknik deskriptif verifikatif dengan pola pikir induktif, pola pikir ini dipakai untuk menganalisis data khusus berdasarkan kenyataan-kenyataan dari hasil riset kemudian diambil kesimpulan yang bersifat umum. Hasil penelitian ini menerangkan bahwa dalam praktik lelang online dalam Group Lelang Indo Gamer di facebook, rukun dan syarat jual beli lelang tersebut tidak terpenuhi dalam shigat akadnya, karena adanya praktek bid and run yang dari pembeli yang jelas berkhianat dalam akad perjanjian yang disepakati dalam lelang, dan hal ini pun dapat mengakibatkan tidak terpenuhinya prinsip an-taradhin (keridhaan dua belah pihak yang bertransaksi) dalam jual beli.Kata Kunci: Lelang, Facebook, Bai Muzayyadah |
