Abstract. In connection with the marriage bond, Allah SWT calls it (in the Al-Qur'an Surat An-Nisa: 21) as mitsaqon ghalidan (very strong agreement). And therefore, any attempt to underestimate the sacred bond or weaken it, let alone decide it is very hated by religion. Divorce is releasing the bond of marriage and ending the relationship between husband and wife, and can be experienced by anyone. Divorce husband mafqud divorce of a woman whose husband is missing and unknown circumstances and truth.This study aims to determine the divorce of husband mafqud Decision No: (7580/Pdt.G/2018/PA.Cmi) according to Munakahat Jurisprudence. The research method used by the author is a qualitative method with a normative juridical approach, through the data collection techniques of literature study and descriptive analysis techniques. The result of his study is the divorce of mafqud husband according to the decision number: (7580/Pdt.G /2018/ PA.Cmi). A lost husband (mafqud/ghoib) will certainly cause new problems for the household. The loss of a husband will make a wife overwhelmed with a sense of uncertainty about the legal status she has. Husband mafqud on Decision Number: 7580/ Pdt.G/2018/PA.Cmi is in accordance with Munakahat Jurisprudence, if one of the parties leaves two years in a row, and the party left submits a claim to the Religious Court then one ba'in falls divorce sughra.Keywords: Munakahat Jurisprudence, Decision, Divorce, Husband mafqud.Abstrak. Perceraian adalah melepaskan ikatan pernikahan dan mengakhiri hubungan suami isteri, dan bisa dialami oleh siapa saja. Perceraian suami mafqud perceraian seorang wanita yang suaminya hilang dan tidak diketahui keadaan serta kebenarannya. Penelitian ini bertujuan untuk mengetahui perceraian suami mafqud Putusan No: (7580/Pdt.G/2018/PA.Cmi) menurut Fikih Munakahat. Metode penelitian yang digunakan penulis adalah metode kualitatif dengan pendekatan yuridis normative, melalui teknik pengumpulan data studi pustaka dan teknik deskriptif analisis. Hasil penelitian ini adalah perceraian suami mafqud menurut putusan nomor : 7580/ Pdt.G/2018/PA.Cmi. Suami yang hilang (mafqud/ghoib) tentunya akan menimbulkan berbagai persoalan baru bagi rumah tangga. Hilangnya seorang suami akan membuat seorang isteri diliputi rasa ketidakjelasan tentang status hukum yang dimilikinya. Suami mafqud pada Putusan Nomor: 7580/ Pdt.G/ 2018/ PA.Cmi telah sesuai dengan Fikih Munakahat, apabila salah satu pihak meninggalkan dua tahun berturut-turut, dan pihak yang ditinggalkan mengajukan gugatan ke Pengadilan Agama maka jatuhlah talak satu ba’in sughra.Kata Kunci : Fikih Munakahat, Putusan, Perceraian, Suami mafqud. |
