dc.description Abstract. This research is based on the problems occurring in failed state countries especially Somalia and Haiti and some other failed state countries that can threaten international peace and security. This paper addresses the extent to which the role of the United Nations Council of Justice in assisting failed state states and the implementation of the Security Council's authority to safeguard international peace and security in assisting a failed state country under international law. In this essay to answer the problem, the author examines the theory of international law and examines the Charter of the United Nations and other sources of international law and examine failed state countries, especially the State of Somalia and Haiti. The method used in this research is the normative juridical method. The study concludes that the UN Security Council's authority to intervene against failed states is a progressive intervention against Article 39 and Article 42 of the UN Charter, categorizing it as a threat to international peace and security both to UN member states and to non-member States. Regarding its implementation, the role of the UN Security Council is not in accordance with Chapter VI and Chapter VII of the UN Charter. The UN Security Council needs to re-adjust its functions and authorities and its implementation as in the UN Charter.Keyword: Security Council, Failed State, Charter of the United Nations.Abstrak. Penelitian ini dilatar belakangi oleh adanya permasalahan yang terjadi di negara-negara failed state  khususnya Somalia dan Haiti dan beberapa negara failed state lainnya  yang dapat mengancam perdamaian dan keamanan internasional.  Tulisan ini mempermasalahkan sejauh mana peran Dewan Keamaanan PBB dalam membantu negara-negara yang berstatus failed state dan  implementasi kewenangan Dewan Keamanan untuk menjaga perdamaian dan keamanan internasional dalam membantu negara yang berstatus failed state menurut hukum internasional. Pada skripsi ini untuk menjawab permasalahan tersebut,  penulis mengkaji dari teori hukum internasional dan mengkaji Piagam PBB dan sumber hukum internasional lainnya serta mengkaji Negara failed state khususnya Negara Somalia dan Haiti.   Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif. Hasil penelitian menyimpulkan bahwa Kewenangan Dewan Keamanan PBB untuk melakukan intervensi terhadap failed state merupakan suatu intervensi progresif terhadap Pasal 39 dan Pasal 42 Piagam PBB, dengan mengkategorikannnya sebagai suatu ancaman terhadap  perdamaian dan keamanan internasional baik negara angota PBB maupun negara yang bukan angota PBB. Mengenai implementasinya, peran Dewan Keamanan PBB belum sesuai dengan  Bab VI dan Bab VII Piagam PBB. Dewan Keamanan PBB perlu melakukan penyesuaian kembali terhadap fungsi dan kewenangannya serta implementasinya sebagaimana dalam Piagam PBB.  Kata Kunci: Dewan Keamanan PBB, Failed State, Piagam PBB.
