Abstract. This research is distributed with the emergence of the child artist in the entertainment industry in Indonesia are under age of 18 (eighteen) years age. One of them became a soap opera performer requires that undergo the process of shooting every day even late into the night. soap production and management of the artist as a young artist that employs naturally want maximum results in this entertainment industry business, often a child artist must display maximum performance and professionalism in the work to the exclusion of his rights as the child. Research methods used in the writing of this final project is to use methods of juridical normative approach which aims to examine the secondary data obtained in relation to the problems examined. Then the data obtained were analyzed qualitatively. The specifications used are descriptive research analytical method, followed by data collection through the study of librarianship and interviews. Based on the results of the research, that employers who employ children as stipulated in article 69 paragraph (1) employment law must meet the requirements under Article 69 (2) and section 71 paragraph (2) as well as while respecting the rights of the child listed in articles 6, 9, 10, 11, 13 of the child protection act. In practice, some of the terms and conditions of the Act have been met by the production house soap opera and management of artist, but not a few were also violated. In addition, on the soap opera production in actuality as well as management of artists employ children from ages 3 years to 15 years of age as a child artist, this certainly violated the provision in employment law. Subject protection for minors in that profession as a child artist, production does not give a good protection and even override the rights of the child in child protection laws, which were to be able to rest, enjoy your leisure time, and live at school.Keywords: Child Actress, Hiring Minors, Child Protection, Production House, Artist ManagementAbstrak. Penelitian ini dilatarbekangi dengan adanya kemunculan artis anak dalam industri hiburan di Indonesia yang berusia di bawah 18 (delapan belas) tahun. Salah satunya menjadi pemain sinetron yang mengharuskan menjalani proses shooting setiap hari bahkan hingga larut malam. Rumah produksi sinetron dan manejemen artis sebagai yang mempekerjakan artis cilik tentu menginginkan hasil yang maksimal di dalam bisnis industri hiburan ini, seringkali artis cilik harus menampilkan performa yang maksimal serta profesionalitas dalam bekerja dengan mengesampingkan hak-hak nya sebagai anak. Metode penelitian yang digunakan dalam penulisan tugas akhir ini adalah menggunakan metode pendekatan yuridis normatif yang bertujuan untuk mengkaji data sekunder yang didapatkan dalam hubungannya dengan permasalahan yang diteliti. Data yang diperoleh kemudian dianalisis secara kualitatif. Spesifikasi penelitian yang digunakan adalah deskriptif analitis, dilanjutkan dengan metode pengumpulan data melalui cara studi kepustakaan dan wawancara. Berdasarkan hasil penelitian, bahwa pengusaha yang mempekerjakan anak sebagaimana dimaksud dalam Pasal 69 ayat (1) Undang-undang Ketenagakerjaan harus memenuhi persyaratan yang diatur dalam Pasal 69 (2) dan Pasal 71 ayat (2) serta tetap menghargai hak anak yang tercantum dalam Pasal 6, 9, 10, 11, 13 Undang-undang Perlindungan Anak. Dalam praktiknya, beberapa syarat dan ketentuan dalam Undang-undang tersebut telah dipenuhi oleh rumah produksi sinetron dan manejemen artis, akan tetapi tak sedikit juga dilanggar. Selain itu, pada kenyatannya rumah produksi sinetron serta manejemen artis mempekerjakan anak dari usia 3 tahun sampai 15 tahun sebagai artis cilik, hal ini tentu melanggar ketentuan dalam Undang-Undang Ketenagakerjaan. Perihal perlindungan bagi anak di bawah umur yang berprofesi sebagai artis cilik, rumah produksi tidak memberikan perlindungan yang baik dan bahkan mengesampingkan hak anak dalam Undang-undang Perlindungan Anak, diantaranya untuk dapat beristirahat, menikmati waktu luang, dan menjalani waktu sekolah.Kata Kunci: Artis cilik, Mempekerjakan Anak, Perlindungan Anak, Rumah Produksi, Manejemen Artis |
