Abstract. The advancement of informational technology and the appearance of internet has brought us many new legal problems, especially the issue of Copyright. People can easily perform a Copyright Infringement in the internet, for example by using other people’s works for economic profits by ‘monetization’ without having any consent like the uploaded cover songs in YouTube. YouTube reacted to these Copyright issues by providing a Copyright Management feature which can be used by Authors to solve or prevent Copyright Infringement, with the condition that authors should register and provide evidence of the ownership of exclusive right using Legal Work Register Document. The condition contradicts the ruling of Indonesian Copyright Act No. 28 in year of 2014 because declarative principal states that the registry of a copyrighted work is not obligatory by law.Keywords: Copyright, Declarative Principal, YouTube, MonetizationAbstrak. Perkembangan teknologi informasi dan kemunculan internet telah menimbulkan permasalahan hukum baru, terutama di bidang Hak Cipta. Orang bisa dengan mudahnya melakukan pelanggaran Hak Cipta di internet, misalnya dengan memanfaatkan Ciptaan orang lain tanpa izin untuk keuntungan ekonomi dengan fitur ‘monetisasi’ seperti cover lagu yang diunggah di YouTube. YouTube merespon permasalahan Hak Cipta tersebut dengan menyediakan fitur Pengelolaan Hak Cipta yang dapat digunakan oleh Pencipta untuk menanggulangi dan mencegah Pelanggaran Hak Cipta, dengan syarat ia harus mendaftar dan membuktikan kepemilikan hak eksklusifnya menggunakan Dokumen Pencatatan Ciptaan yang resmi. Syarat tersebut melanggar ketentuan Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta karena prinsip deklaratif mengatur Ciptaan tidak wajib untuk didaftarkan.Kata Kunci: Hak Cipta, Prinsip Deklaratif, YouTube, Monetisasi
