Abstrack: This research is motivated by the case of the practice of buying and selling grave land in Citalang TPU, Purwakarta Regency in Citalang Village, specifically for Citalang residents to buy grave land in Citalang TPU, when the seller transaction did not provide information about the location of the grave land to the buyer, then at the time of widening of the grave land Citalang residents are asked to buy back the graveyard land at Citalang TPU, even though their rights have not been used, and at Citalang TPU there are special buyer restrictions on Citalang residents so that only Citalang residents can be buried in the TPU. This problem will be reviewed from the DSN MUI Fatwa No. 09 of 2014. This study wants to find out the conditions of buying and selling grave perspective perspective of the DSN MUI Fatwa No. 09 of 2014, the sale and purchase of grave land at Citalang TPU, Purwakarta Regency, and a review of the DSN MUI Fatwa No. 09 In 2014 against the sale and purchase of grave land in Citalang TPU, Purwakarta Regency. The research method is qualitative with a case approach. The data sources are primary and secondary data. Data collection techniques are observation and interviews. The analysis uses descriptive analysis. The results of this study are that the practice of buying and selling grave land in Citalang TPU is not in accordance with DSN MUI fatwa No.09 of 2014 because it does not meet the provisions in the fatwa such as the terms of the sale and purchase requirements are not fulfilled and hinders the right of people to obtain burial services.Keywords: Fatwa DSN MUI No. 09 of 2014, buy and sell, grave landAbstrak: Penelitian ini dilatarbelakangi adanya kasus praktik jual beli lahan kuburan di TPU Citalang Kabupaten Purwakarta di Desa Citalang dikhususkan bagi warga Citalang untuk membeli tanah kuburan di TPU Citalang, pada saat transaksi penjual tidak memberi informasi mengenai lokasi tanah kuburan kepada pembeli, lalu pada saat pelebaran lahan kuburan warga Citalang diminta untuk membeli kembali lahan kuburan di TPU Citalang padahal haknya belum digunakan,serta di TPU Citalang terdapat pembatasan pembeli khusus warga Citalang sehingga hanya warga Citalang saja yang bisa dimakamkan di TPU tersebut. Permasalahan ini akan ditinjau dari Fatwa DSN MUI No 09 Tahun 2014. Penelitian ini ingin mengetahui ketentuan jual beli tanah kuburan perspektif Fatwa DSN MUI No 09 Tahun 2014, pelaksanaan jual beli lahan tanah kuburan di TPU Citalang Kabupaten Purwakarta, dan tinjauan Fatwa DSN MUI No 09 Tahun 2014 terhadap jual beli tanah kuburan di TPU Citalang Kabupaten Purwakarta. Metode penelitiannya kualitatif dengan pendekatan kasus. Sumber datanya berupa data primer dan sekunder. Teknik pengumpulan datanya adalah observasi dan wawancara. Analisisnya menggunakan analisis deskriptif. Hasil penelitian ini adalah bahwa praktik jual beli tanah kuburan di TPU Citalang tidak sesuai fatwa DSN MUI No.09 Tahun 2014 karena tidak memenuhi ketentuan dalam fatwa seperti syarat jual belinya tidak terpenuhi dan menghalangi hak orang untuk memperoleh pelayanan penguburanKata kunci : Fatwa DSN MUI No. 09 Tahun 2014, Jual Beli, Tanah Kuburan |
