dc.description Abstract. At the Bunga Accessories Store, there were buying and selling practices of imitation cosmetic products. These products are obtained from factories or manufacturers that make artificial imitation cosmetic products and the Toko Bunga who markets them knows that these products are imitation products. The right to trademark is regulated in Islamic law and positive law. The formulation of the problem in this research are 1) how the buying and selling practice of imitation cosmetic product harm the original brand owner according to Islamic law, 2) how to carry out the buying and selling practice of imitation cosmetic products at the Bunga in Balubur Town Square according to Islamic law, and 3) how the Islamic Law review of buying and selling imitation cosmetic products at the Bunga Store in Balubur Town Square. The research was used qualitative method. From the results of the research conducted by the researcher, it can be concluded that; First, according to Islamic law, it is detrimental to the owner of the original mark by taking away the trademark rights of another party which he previously owned. Second, in practice the seller participates in supporting the producer in the sale and purchase of branded counterfeit products. Third, the practice of buying and selling artificial cosmetic imitation products at the Bunga Accessories Store sharia principles because the object being traded is the right of another party's brand, which is recognized as ownership, so that it can harm and violate the MUI Fatwa rule No. 1 / MUNAS VII / MUI / 5/2005 concerning Protection of Intellectual Property Rights (HKI) and Law Number 15 Year 2001 concerning Trademarks.Keyword: Imitation product, brands, IslamicAbstrak. Di Toko Bunga Aksesoris, terdapat praktik jual beli produk kosmetik tiruan bermerek. Produk tersebut didapatkan dari pabrik atau produsen yang membuat produk kosmetik tiruan dan Toko Bunga yang memasarkannya mengetahui bahwa produk tersebut adalah produk tiruan. Hak atas merek diatur dalam hukum Islam dan hukum positif. Rumusan masalah pada penelitian ini adalah bagaimana jual beli kosmetik merek tiruan yang merugikan pemilik merek aslinya menurut hukum Islam, bagaimana pelaksanaan jual beli produk kosmetik tiruan di toko Bunga di Balubur Town Square, dan bagaimana tinjauan hukum Islam terhadap jual beli produk kosmetik tiruan di toko Bunga di Balubur Town Square. Metode yang digunakan yaitu metode kualitatif. Hasil penelitian menyimpulkan: Pertama, menurut hukum Islam merugikan pemilik merek aslinya karena mengambil hak merek pihak lain yang lebih dulu dimilikinya. Kedua, dalam praktinya penjual turut serta mendukung produsen dalam terjadinya jual beli produk tiruan bermerek. Ketiga, praktik jual beli produk kosmetik tiruan di Toko Bunga Aksesoris melanggar prinsip syariah karena objek yang diperjualbelikan merupakan hak merek pihak lain, yang diakui sebagai kepemilikan, sehingga dapat merugikan dan melanggar aturan Fatwa MUI No. 1/MUNAS VII/MUI/5/2005 tentang Perlindungan Hak Kekayaan Intelektual (HKI) dan Undang-Undang Nomor 15 Tahun 2001 tentang Merek.Kata Kunci: Tiruan, Merek, Hukum Islam
