Abstract. Indonesia is a developing country that is still catching up with development, one of which is to utilize funds for national development, its development is carried out through long-term investment, namely by making investment which is a long-term investment for a developing country. However, in this investment licensing arrangement in Indonesia, it is found that the licensing process or procedure is convoluted and layered, so that it seems ineffective and inefficient. Although several agencies have introduced a sophisticated licensing service system by one-stop service units. In fact, the issue of permits issued by the government does not necessarily mean that they can get access to the land in the permit area, whereas, the investors have hired the permit, this makes it difficult for the investors to get the land. This is all due to overlapping regulations and levies by the regions, the government of course must reduce or eliminate these barriers and simplify the related regulations so that investment attractiveness increases again. This research was conducted to determine and analyze the ease of access to land for investment companies that already have investment permits, especially for investment companies in West Java province, related to the principle of maslahah mursalah and to determine legal certainty for investment companies in West Java province that already have permits and not having access to land is linked to the principle of maslahah mursalah. Based on the research obtained, there are constraints and problems with investment in West Java due to overlapping regulations between central and regional regulations that cause the fulfillment of land services that should be given to investors experiencing many obstacles in the field. Abstrak. Indonesia merupakan negara berkembang yang masih mengejar ketertinggalan pembangunan salah satunya untuk memanfaatkan dana untuk pembangunan nasional, pembangunannya dilakukan melalui investasi jangka panjang yaitu dengan cmelakukan penanaman modal yang merupakan suatu investasi jangka Panjang bagi negara yang sedang berkembang. Akan tetapi dalam Pengaturan perizinan penanaman modal di Indonesia ini ditemukan proses atau prosedur perizinan berbelit-belit dan berlapis, sehingga terkesan tidak efektif dan efisien. Walaupun beberapa instansi sudah memperkenalkan sistem pelayan perizinan yang mutakhir oleh unit pelayanan satu atap. Bahkan adanya persoalaan perizinan yang dikeluarkan pemerintah belum tentu bisa mendapatkan akses ke lahan area izin sedangkan, pihak investor telah mengngantongi izin, hal ini membuat pihak investor kesusahan untuk mendapatkan lahan tersebut. Itu semua disebabkan adanya tumpang tindih peraturan dan pungutan oleh daerah , pemerintah tentunya harus mengurangi atau menghilangkan hambatan- hambatan tersebut dan menyederhanakan aturan-aturan terkait agar daya tarik investasi meningkat lagi.Penelitian ini dilakukan Untuk mengetahui dan menganalisis kemudahan akses lahan bagi perusahaan penanaman modal yang telah mempunyai izin investasi khususnya bagi perusahaan penanaman modal di provinsi jawa barat dihubungkan dengan prinsip maslahah mursalah dan untuk mengetahui kepastian hukum bagi perusahaan penanaman di provinsi jawa barat yang sudah mempunyai izin dan belum mendapatkan akses lahan dihubungkan dengan prinsip maslahah mursalah.Berdasarkan penelitian yang diperoleh, adanya kendala dan permasalahan penanaman modal di jawa barat karena peraturan yang tumpang tindih antara peraturan pusat dan daerah yang menyebabkan pemenuhan dinas atas lahan yang seharusnya diberikan kepada investor banyak mengalami kendala di lapangan.
