Abstract. Increasing the number of deaths caused by Covid-19 in Indonesia, the Indonesian government issued a policy in the form of Ministerial Decree Number HK.01.07 / Menkes / 413 / 2020 on Guidelines for prevention and control of Corona Virus Disease 2019 (Covid-19) in the policy there are health protocols regarding the burial of Covid-19 bodies. This study aims to find out how law enforcement and the role of the government towards the act of refusing the burial of Covid-19 bodies based on health protocols. The research used here is a normative juridical approach, the research specifications are descriptive analytical and the analysis method is qualitative juridical. The first formula conclusion is that there is no countermeasure in the act of refusing the burial of Covid-19 bodies based on health protocols both from the authorities and from the community. The second formulation conclusion is that the government has performed its role by issued a sanctions policy for citizens who are not disciplined health protocols but in that policy there are no sanctions regarding violators of the act of refusing the burial of Covid-19 bodies. Abstrak. Meningkat pesatnya jumlah kasus kematian yang disebabkan Covid-19 di Indonesia, pemerintah Indonesia mengeluarkan kebijakan berupa Keputusan Menteri Nomor HK.01.07 / Menkes / 413 / 2020 tentang Pedoman Pencegahan dan Pengendalian Corona Virus Disease 2019 (Covid-19) di dalam kebijakan tersebut terdapat protokol kesehatan mengenai penguburan jenazah Covid-19. Penelitian ini bertujuan untuk mengetahui bagaimana penegakan hukum dan peran pemerintah terhadap tindakan menolak penguburan jenazah Covid-19 berdasarkan protokol kesehatan. Penelitian yang digunkan disini adalah pendekatan yuridis normatif, spesifikasi penelitiannya berupa deskriptif analitis dan metode analisisnya berupa yuridis kualitatif. Kesimpulan rumusan pertama yaitu tidak ada nya upaya penanggulangan dalam tindakan menolak penguburan jenazah Covid-19 berdasarkan protokol kesehatan baik dari pihak aparat maupun dari masyarakat. Kesimpulan rumusan kedua yaitu pemerintah telah melakukan perannya dengan mengluarkan kebijakan sanksi bagi warga yang tidak disiplin protokol kesehatan namun dalam kebijakan itu tidak terdapat sanksi mengenai pelanggar tindakan menolak penguburan jenazah Covid-19. |
