Abstract. Copyright is part of intellectual property rights in which it has economic rights and moral rights. In reality there are still a lot of movie piracy activities carried out on illegal streaming website platforms. Therefore, this research aims to know the responsibilities that must be carried out by the platform of illegal streaming websites based on Law No. 28 of 2014 on Copyright is linked to Law No. 19 of 2016 on Amendment to Law No. 11 of 2008 on Information and Electronic Transaction. The results of research on the responsibility of streaming website platforms reviewed from the Copyright Law are linked to the principle of civil liability, including into the principle of liability due to the element of error while in the Information and Electronic Transactions Act is included in the absolute responsibility. The implementation of responsibility as stipulated in the Copyright Law and ITE Law is also not at all implemented by the IndoXXI streaming website platform. Abstrak. Hak cipta adalah bagian dari hak kekayaan intelektual di mana ia memiliki hak ekonomi dan hak moral. Pada kenyataannya masih ada banyak kegiatan pembajakan film yang dilakukan di platform situs web streaming ilegal berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta terkait dengan Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Hasil penelitian tentang tanggung jawab platform situs web streaming yang ditinjau dari Undang-Undang Hak Cipta terkait dengan prinsip pertanggungjawaban perdata, termasuk ke dalam prinsip tanggung jawab karena unsur kesalahan sementara dalam Undang-Undang Informasi dan Transaksi Elektronik termasuk dalam tanggung jawab mutlak. |
