Abstract. The complaint offense in copyright infringement prevents the authorities from taking action against violations of the related rights without a complaint from the aggrieved party. Amid the increasingly massive technological developments so that they can be accessed easily by the public, causing crimes to proceed faster than the investigation process by the authorities, will result in greater losses of economic benefits from the relevant rights holders. This study aims to determine the re-evaluation of complaint offenses in an effort to reduce violations of rights related to unauthorized viewing through illegal streaming. The methodology used in the writing of this thesis is a normative juridical approach, descriptive analytical research specifications, and the analytical method used is in the form of qualitative juridical. Thus resulting to a complaint that the application of a little hamper the investigation process, with this evaluation of the offense becomes ordinary offense will be giving a sense of fairness and legal certainty to the holders of related rights.Abstrak. Delik aduan dalam pelanggaran hak cipta membuat pihak berwenang tidak dapat melakukan penindakan terhadap pelanggaran hak terkait tanpa adanya pengaduan dari pihak yang dirugikan. Ditengah perkembangan teknologi yang semakin masif sehingga dapat diakses secara mudah oleh masyarakat menyebabkan kejahatan berjalan lebih cepat dibandingkan proses penyidikan oleh pihak yang berwenang, akan menyebabkan kerugian atas manfaat ekonomi dari pemegang hak terkait semakin besar. Penelitian ini bertujuan untuk mengetahui Re-Evaluasi delik aduan dalam upaya mengurangi pelanggaran hak terkait atas penayangan tanpa izin melalui streaming illegal. Metodologi yang digunakan dalam penulisan skripsi ini adalah pendekatan yuridis normatif, spesifikasi penelitian deskriptif analitis, dan metode analisis yang digunakan berupa yuridis kualitatif. Sehingga dihasilkan bahwa penerapan delik aduan sedikit menghambat proses penyidikan, dengan hal ini evaluasi delik menjadi delik biasa akan lebih memberikan rasa keadilan dan kepastian hukum kepada para pemegang hak terkait. |
