Abstract. In trading activities of goods or services, a brand is a form of intellectual work that is important for the smooth running and increasing trade in goods or services. A brand of goods or services that can be accepted by the wider community requires a long journey process. Companies must strive so that the brands they use can be accepted by the public, Not a few of the business actors are looking for profits by utilizing well-known brands.Some of the problems raised in the writing of this thesis are to find out the regulation of Pertamina's legal protection for the use of Pertamina's logo which is used by business actors without a license and the efforts made by Pertamina to overcome the use of the logo by Pertamini's BBM business actors. This research uses normative juridical analysis method. Data obtained through literature study, online data. The results of this study explain that the guarantee of legal protection in the Trademark Law and geographical indications and theories of legal protection. Countermeasures in dealing with the use of the Pertamina logo include prevention and repressive measures from a criminal perspective. Internal efforts and external efforts from a civil perspective. And non-legal efforts made by Pertamina. Abstrak. Dalam aktifitas perdagangan barang atau jasa, merek sebagai salah satu bentuk karya intelektual yang penting bagi kelancaran dan peningkatan perdagangan barang atau jasa. Suatu merek dari barang atau jasa dapat diterima oleh masyarakat luas membutuhkan proses perjalanan yang panjang. Perusahaan harus mengupayakan agar merek yang mereka gunakan dapat diterima oleh masyarakat, tidak sedikit dari para pelaku usaha yang mencari keuntungan dengan memanfaatkan merek terkenal.Beberapa permasalahan yang diangkat dalam penulisan skripsi ini ialah untuk mengetahui pengaturan perlindungan hukum Pertamina atas penggunaan logo pertamina yang digunakan pelaku usaha tanpa izin dan upaya yang dilakukan Pertamina untuk mengatasi penggunaan logo oleh pelaku usaha BBM Pertamini. Penelitian ini menggunakan metode analisis yuridis normatif. Data diperoleh melalui studi pustaka, data online. Hasil dari penelitian ini menjelaskan bahwa pengaturan perlindungan hukum sudah di atur dalam UU merek dan indikasi goegrafis dan melalui teori-teori perlindungan hukum. Serta mengetahui upaya dalam mengatasi penggunaan logo pertamina yang meliputi upaya preventif dan upaya represif dari segi pidana. Upaya internal dan upaya eksternal dari segi perdata. Dan upaya non-hukum yang dilakukan oleh pertamina. |
